Technical Change to the Torquay Neighbourhood Plan

Purpose:

As approved by Council, each of the three Neighbourhood Plans (Torquay, Paignton, and Brixham Peninsula) will be put to referendum (expected May 2019). If more than half of those voting at the referendum have voted in favour, considering each plan separately, the Authority must make the respective Plan(s) (adopt as part of the Development Plan) as soon as reasonably practicable after the referendum is held.

Decision:

That the technical changes to the Torquay Neighbourhood Plan and Map attached at Appendix 1 to this Record of Decision be approved.

Reasons for the decision:

To enable the approved Torquay Neighbourhood Plan to be considered at the Neighbourhood Planning Referendum on 2 May 2019 at the same time as the Paignton Neighbourhood Plan and Brixham Peninsula Neighbourhood Plan.

This decision will come into force immediately.

Information:

At the extraordinary Council meeting held on 15 November 2018 the Council approved the contents of the Torquay Neighbourhood Plan and gave delegated powers to the Assistant Director of Transport and Planning to ensure that the Policy maps are finalised for inclusion of the Plan prior to the referendum on 2 May 2019, reflecting all modifications set out in the decision statement in Appendix 2 to the submitted report (Minute 110/11/18 refers).

 

The policy maps have been updated to reflect the decision statement.

 

Minor technical changes to the plan have also been necessary in respect of Policy TH1, TJ1 and TE6 for clarity in respect of meeting the requirements of the Habitats Regulations, also reflected within an updated Torquay Neighbourhood Plan Habitats Regulation Assessment (HRA), and to ensure that the detail within the Decision Statement is accurately reflected within the Referendum version of the Torquay Neighbourhood Plan. This includes referencing the HRA within TE6 and cross-referencing to it from TH1 and TJ1, plus adjusting erroneous text.  This is a legally necessary change.

 

The above changes have now been made to the Torquay Neighbourhood Plan and the final Plan with Policy Map is attached to this Record of Decision.
