Sometimes, water will appear through the surface of the highway or on private property as a result of a build up of ground water or the emergence of a spring. Where the water causes a nuisance, it is the owner of the land from which the water surfaces that holds the responsibility to attend to the issue. If water runs across the highway from private property so as to cause a nuisance, we can issue notice on the property owner to undertake such works so as to prevent the water from running across the highway.
