Many trees in Torbay are protected by TPOs. Trees in Conservation Areas are automatically given similar protection status.
TPOs are usually made to preserve trees with landscape and amenity value. TPOs can protect four main categories:
It is illegal to cut down, top, lop, uproot, damage or destroy a tree protected by a TPO. If we allow the removal of a tree protected by a TPO, we can make it a requirement that you plant a replacement.
The only time you may carry out minimum work without an application would be to make it safe. This would be if a tree or branch is dangerous and could cause harm. You would need to notify us of any emergency works.

To apply for a Tree Preservation Order (TPO) on a tree, please fill out this online form. But first, make sure the tree is not already under protection.
Conservation Areas are sites designated by us. It is to recognise their special built environment characteristics. All trees within the boundaries of a Conservation Area are protected. It is illegal to lop, top, damage or destroy them without prior consent from us. If a tree within a Conservation Area is felled there is no legal obligation to replace it. This is unless the tree was removed because it was dead, dying or dangerous.
Before carrying out work, check to find out whether the tree is subject to a Tree Preservation Order or is in a conservation area.
