Change or discharge a section 106

The local authority and developer can renegotiate a planning obligation at any point if they wish. This would be in cases where both of the following apply:  

• there is no agreement to voluntarily renegotiate 

• the planning obligation predates April 2010 or is over 5 years old 

You must apply to the local planning authority to do this. This applies if the obligation: 

• no longer serves a useful purpose 

or 

• would continue to serve a useful purpose in a modified way
