The Council will not be liable for any damage howsoever caused to any vehicle whilst parked in a Torbay Council car park unless such damage is directly caused by any act of negligence on the part of the Council.
The Applicant must ensure that their vehicle is positioned wholly within the markings of a car park bay, and not in such a position as to unreasonably interfere with or prevent the use of any access ways.
The Applicant shall not permit any vehicle to park in a Torbay Council car park unless the vehicle is licensed in accordance with the provisions of the Vehicle Excise and Registration (VERA) Act 1994.
The applicant shall not permit any vehicle to park in a Torbay Council car park unless the vehicle has a full and valid MOT in accordance with Sections 45 and 46 of the Road Traffic Act 1988.
The Applicant shall not permit any vehicle to park in a Torbay Council car park unless they hold a valid policy of insurance for the vehicle.
The Applicant shall ensure that their vehicles’ licence plate (vehicle registration mark) is visible at all times when parked in any Torbay Council off street parking place.
The Applicant shall not in any Torbay Council car park make any loud noise or cause or permit any disturbance or annoyance to residents of the premises in the neighbourhood.
The Applicant shall not use any part of the car parks, or any vehicle left in the car parks for sleeping or camping purposes or use the car parks for the purpose of servicing, cleaning or washing any vehicle other than is reasonably necessary to enable that vehicle to depart from the car parks.
The Applicant shall not transfer or permit to be transferred any fuel out of or into a vehicle except where necessary to allow the vehicle to be driven.
Please note that the My Bay parking permit is not valid for use in Lower Union Lane Multi-storey car park (barrier exit), or Shoppers car park (maximum stay of 1 hour).
The car park permit is issued subject to the availability of a parking space and does not entitle you to any precedence over other car park users.
The instructions of Civil Enforcement Officers, Parking Services staff, and relevant signs within the car parks must be complied with at all times, this includes maximum parking periods in short stay car parks. The My Bay parking permits are not valid for use in Shoppers car park (maximum stay of 1 hour), and the permit does not allow the user to park beyond the 3 hour maximum stay in Brixham Central and Great Western car parks.
The applicant shall ensure that they adhere to any other conditions of use specified within Torbay Councils current Off Street Parking Places Order.
No refunds will be given under any circumstances including in the event of force majeure.
The permit is only valid for use in the vehicle registration number specified to My Bay.
Any changes to the permit or the Applicants details will require a new permit via the request a replacement permit/ card process, and a non-refundable administration fee of £5.00 will be payable.
Car Park Permits are valid in Torbay Council Off Street Car Parks only; they are not valid for use in any on street pay and display parking places.
Torbay Council will use any data provided within this application form for the issuing of parking permits and will be used for automatic detection of outstanding enforcement It may also be disclosed to other departments within the Council or other external parties for related purposes or as required by law.
