Environmental crime impacts upon the quality of our environment, reduces our pride of place and can have negative and economic impacts.

Fixed penalty notices (FPN) are now being issued in Torbay for a range of environmental crimes including littering, fly tipping, and failing to present domestic or waste bins correctly. They will also be issued for abandoned vehicles, graffiti, failing to produce a waste transfer note, and dog control.

We will also soon be launching a consultation on public space protection orders to tackle dog poo, with a view to issuing fixed penalty notices against people who fail to pick up after their dog.

Appeal your FPN

You cannot appeal a fixed penalty notice. An FPN is an invitation for you to effectively discharge your liability to prosecution. In essence, this means that if you agree that an offence has been committed by you then by paying the sum of money specified there will be no further action in the form of prosecution for the offence. You can however make a representation to be considered by National Enforcement Solutions. This might be that you feel that the FPN was issued incorrectly. All representations must be made in writing.
