Privacy notices for the Channel Panel

What information do we need?

We need to hold certain information about you in order to effectively deliver the Channel process. Channel is a statutory duty set out in sections 36 to 41 of the Counter-Terrorism and Security Act 2015. Channel provides early support for anyone who may be vulnerable to being drawn into any form of terrorism or supporting terrorist organisations, regardless of age, faith, ethnicity, or background.

In the course of delivering our responsibilities under the duty, we collect the following personal information about you, either when you provide it to us or from another member of the Torbay Channel Panel, such as police, probation, health, adult services, children’s services, or education services:

  • Name
  • Address
  • Date of birth
  • Contact details
  • Relevant family member and associate details
  • Gender
  • First language
  • Relevant Social Care information

We also collect the following special category personal data:

  • Relevant medical information (if applicable)
  • Religious beliefs (if applicable)
  • Ethnicity
  • Criminal records and conviction data

Why we need it?

Torbay Council has statutory duties under sections 36 to 41 of the Counter-Terrorism and Security Act 2015 to deliver Channel. Channel is a multi-agency approach to protect people who may be vulnerable to being drawn into terrorism by:

  • Identifying individuals at risk
  • Assessing the nature and extent of that risk
  • Developing the most appropriate support plan for the individuals concerned.

Therefore, the lawful basis on which we collect and use your personal data is that the ‘processing is necessary for the completion of task carried out in the public interest or in our official authority’.

The lawful basis we rely on for the processing of special category data is that the ‘processing is necessary for the reasons of substantial public interest’ which include our duties under the Counter Terrorism and Security Act 2015 and our duty to prevent and detect unlawful acts.

Do we share your information?

As part of the Channel process, personal information is collected from and shared with other agencies to inform our assessment and to consider whether intervention support should be offered. This is done only where strictly necessary with relevant agencies, but could include:

  • Police
  • Health (hospitals/GP)
  • Home Office
  • Immigration Services
  • Probation
  • Other Local Authorities
  • Schools or colleges

How long do we keep your information?

We will hold your personal information for 7 years after our support has ended. After this period the information will be reviewed, and only retained where there is an ongoing requirement to retain for a statutory or legal purpose. Following this, your personal information will be securely destroyed.

Your Information Rights

Under Data Protection Law, you can request to have a copy of the information we hold about you, and if you feel the information we process about you is incorrect you can request to have it corrected or deleted.
