With the agreement of the Sub-Committee a copy of an e-mail dated 20 February 2012 was circulated by the Senior Licensing Officer from the Applicant, which confirmed that he accepted the conditions suggested by the Police except for Section P(b) additional item - point 7.
Applicant’s response to Representations:
The Applicant confirmed that they had received a copy of the Representation from the Police Licensing Department and had viewed their Representation and accepted all but one of the 16 changes. The Applicant informed Members that they could not agree to Section P(b) additional item – point 7, as the proposed condition was unclear in its meaning and he could not see how, in his opinion that it sought to promote any of the Licensing Objectives.
Following negotiations between the Applicant and the Police, Section P(b) – point 7 was re-written in to two separate conditions proposed by the Police and agreed by the Applicant:
1. When an Officer from Devon and Cornwall Constabulary of the rank of Inspector or above assesses with the Premises Licence Holder that the provision of Special Police Services is necessary, the Premises Licence Holder must arrange for these services to be provided prior to any event taking place.
2. The Premises Licence Holder must provide and maintain free from obstruction, an identified entry and exit point which enables the Police to access the site.
(Note: in accordance with Standing Order A19.5 Councillor Faulkner (A) requested that his vote against the decision be recorded).
Decision:
That the application for a Premises Licence for Paignton Green, Paignton be granted as applied for, subject to the additional 17 conditions proposed by the Police and agreed by the Applicant.
Having carefully considered all the written and oral Representations, Members resolved that the grant of the Licence would, by the imposition of the additional 17 conditions promote the Licensing Objectives in relation to The Prevention of Crime and Disorder, Public Safety and The Protection of Children from Harm. |
