General
1. Films and live music performance shall be for residents staying at the Ferndale Hotel only and their bona fide friends.
2. Dancing shall be for residents staying at the Ferndale Hotel only and their bona fide friends.
The prevention of crime and disorder.
1. The entrance to the hotel shall be through a locked door with only the residents having a key for entry.
2. CCTV shall monitor the car park area and entrance to the hotel, with the recorded tapes being available for at least 14 days.
3. ID shall be requested on registration of their stay to prevent the sale of alcohol to under 18s.
4. The hotel is within an alcohol free zone and a notice shall be displayed to this effect on exit of the hotel.
5. Plastic glasses shall be provided for drinks taken outside into the grounds.
6. The hotel shall adhere to their No Smoking policy.
Public safety
1. A log book or recording system shall be kept upon the premises in which shall be entered all relevant information required by the Licensing Act 2003. The information shall be produced by persons authorised on request.
2. Adequate access shall be provided for emergency vehicles.
3. All fittings and apparatus therein, door fastenings, notices, seating, lighting, heating, electrical, ventilation, sanitary accommodation, washing facilities and other installations, shall be maintained at all times in a good, safe, working condition.
4. A suitable clearly identifiable area shall be available for the purpose of dancing. The minimum area to be set aside shall be just over four square metres for a maximum of 30 who are in residence staying at the hotel and their bona fide friends only.
5. A separate cool ventilated seating area shall be available away from the main dance area, as a respite from noise.
6. Cold drinking water and other non alcoholic drinks shall be available at the bar and a notice of the availability shall be prominently displayed at suitable locations within the premises.
The prevention of public nuisance
1. Noise or vibration shall not emanate from the premises such as to cause persons in the neighbourhood, or in the hotel to be unreasonably disturbed:-
(i) Before 11pm - Noise emanating from the premises shall not be clearly distinguishable above other noise.
(ii) After 11pm - Noise emanating from the premises shall not be distinguishable above background levels of noise.
2. The volume of amplified sound used in connection with the entertainment provided shall at all times be under the control of the Licensee/Management and the controlling mechanism shall be operated from a part of the premises not accessible to the public.
3. Prominent, clear and legible notices shall be displayed at all exits requesting the public to respect the needs of local residents and to leave the premises and the area quietly.
4. Explosives, pyrotechnics and fireworks of a similar nature which could cause disturbance in surrounding areas shall be restricted.
5. The placing of refuse, such as bottles, into receptacles outside the premises shall take place at times that will prevent disturbance to nearby residents.
6. The Licensee shall ensure that staff who arrive early morning or depart late at night when the business has ceased trading shall conduct themselves in such a manner to avoid causing disturbance to nearby residents.
7. Door and windows shall be kept closed during entertainment. to reduce noise break out. A managment scheme shall be in place to ensure this situation remains.
8. Provision of mechanical ventilation and air conditoning system shall not allow nonise breakout from the premises or cause a nuisance by its operation.
The protection of children from harm
1. Alcohol shall not be served to children below the age of 18.
2. The British Board of Fillm Classification certification shall be adhered to.
3. No person under the age of 18 years shall be admitted to any exhibition at which there is to shown any moving picture which has received an '18' certification from the British Board of Film Classifications with the same rules applying for '15' and '12' certifications.
