The Prevention of Crime and Disorder
1. The premises shall not allow the organisation of racist activity or the promotion of racist attacks.
2. There must not be discounted drinks or encourage excessive consumption.
3. There must not be allowed entry to anyone who is intoxicated.
4. There must not be service to anyone who is intoxicated.
5. They shall use toughened glasses, where possible and do not serve drinks in bottles.
6. The premises shall not allow the use of illegal drugs.
7. CCTV shall operate throughout the premises during the times the premises are opened to the public. There shall be a recording system and all recordings shall be kept for a minimum of 14 days during which time the police shall have access at any reasonable time.
Public Safety
1. The premises do not allow prostitution or the sale of unlawful pornography.
2. The premises shall not allow the organisation of racist activity or the promotion of racist attacks.
3. The sale of smuggled tobacco and alcohol shall not be permitted.
The Prevention of Public Nuisance
1. Noise or vibration shall not emanate from the premises such as to cause persons in the neighbourhood to be unreasonably disturbed. Noise from the premises shall not be audible within any dwelling within windows open for normal ventilation especially after 11pm. This shall be assessed from the boundary to the nearest residential properties, on all sides of the licensed premises. The criteria that shall be applied are:-
(a) Before 11pm - Noise emanating from the premises shall not be clearly distinguishable above other noise.
(b) After 11pm - Noise emanating from the premises shall not be distinguishable above background levels of noise.
(c) The local authority shall reserve the right in cases of tonal noise and where premises are attached to others, to make further assessments from within the residential property.
2. The placing of refuse, such as bottles, into receptacles outside the premises shall take place at times that shall prevent disturbance to nearby properties.
3. Deliveries of kegs, bottles, food or other materials necessary for the operation of the business shall be carried out between 7am and 9pm.
4. The handling of beer kegs, bottles and other similar items shall not take place between 9pm and 7am on the outside areas of the Premise.
5. Bottle skips and bins containing cans or bottles shall not be emptied outside after closing but shall be dealt with the next day during normal office hours.
6. Measures shall be taken to deal with potential nuisance, e.g. noise from music.
7. There shall be signs near the exit requesting that patrons leave the premises quietly and to disburse away from the premises as quickly as possible.
8. A senior member of staff (manager) shall assess the impact of any noisy activities on neighbouring residential premises at the start of the activity/entertainment and periodically throughout the activity/entertainment to ensure levels of noise have not increased.
9. All windows and doors must be kept shut during regulated entertainment, except for access and egress.
10. The outside terrace area at the front of the premises shall not be used for the consumption of late night refreshments or alcohol after 11pm.
11. Cooking, noxious or persistent smells from the premises shall not cause a nuisance to nearby properties and the premises must be properly vented.
12. Double glazing to be installed in the two front windows of the premises.
13. On Friday, Saturday, Sunday, Christmas Eve and New Year's Eve from 22:00 until closing an SIA qualified door steward shall be employed at the premises to monitor the external frontage of the premises and to assist in minimising noise levels. The external frontage is not to be used by patrons on these days from 22:00 until closing except for access and egress, and patrons will not linger in this area at such times.
14. Staff and management to be reminded to leave the premises as quietly as possible after closing.
15. An external smoking area within the structure of the premises is to be created. No drinks shall be taken into the smoking area and the number of people using the smoking area shall be monitored and controlled by the bar staff.
16. The staff and management shall discourage the use of the external frontage of the premises for smoking by customers (except by persons who are disabled or elderly who cannot use the stairs to the smoking area).
17. The premises operate a 'Preferred Taxi Service'. Patrons are advised to contact this taxi service or ask a member of staff to contact them. Patrons will be asked to remain inside whilst awaiting taxis and when on duty the door steward will watch out for taxis and alert patrons that their taxi is waiting so that disturbance is minimised. Signs will be placed in conspicuous positions asking patrons to use the Preferred Taxi Service. Arrangements will be made with the Preferred Taxi Service to minimise noise during pick up.
The Protection of Children from Harm
1. If in doubt, you must ask for age identification.
2. You must not serve minors.
