ANNEXE 1
MANDATORY CONDITION: WHERE LICENCE AUTHORISES SUPPLY OF ALCOHOL

1)       No supply of alcohol may be made under the premises licence:-

()        at a time where there is no designated premises supervisor in respect of the premises licence , or

()        at a time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended.

2)              Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
ANNEXE 2

CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
(a)              General

              1.              There shall be clear and concise signs and guidance to all bar staff as to the licencing objectives.

              2.              There shall be clear and concise signs informing patrons as to the objectives the premises complies with.

(b)              Prevention of Crime and Disorder

              1.              A CCTV camera system must be in operation 24 hours a day and recorded and saved for minimum of 28 days.

              2.              The use or distribution of Class A Drugs must not be allowed.

              3.              Prostitution, or the sale of unlawful pornographic material must not be allowed.

              4.              Gaming or gambling must not be permitted on the premises.

              5.              The organisation of racist activity, or the promotion of racist attacks must not permitted.

              6.              The sale of smuggled/contraband tobacco and alcohol must not be permitted.

              7.              Any person who is clearly intoxicated must not be served.

              8.              Anti social behaviour must be stopped immediately.

              9.              There must be a clear and concise policy to keep out undesirables and known troublemakers.

(c)              Public Safety

              1.              A CCTV camera system must be in operation 24 hours a day and recorded and saved for minimum of 28 days.

              2.              The use or distribution of Class A Drugs must not be allowed.

              3.              Prostitution, or the sale of unlawful pornographic material must not be allowed.

              4.              Gaming or gambling must not be permitted on the premises.

              5.              The organisation of racist activity, or the promotion of racist attacks must not permitted.

              6.              Any person who is clearly intoxicated must not be served and excessive consumption must not be encouraged.

              7.              Anti social behaviour must be stopped immediately.

              8.              There must be a clear and concise policy to keep out undesirables and known troublemakers.

              9.              Bar staff shall be instructed to promote the use of taxis.

              10.              If a customer does become intoxicated, safe transport home shall be arranged.

(d)              The Prevention of Public Nuisance

              1.              There must be a sign in a prominent position at the exit telling patrons to be quiet on departure from the premises.

              2.              Notice in position at the exit informing patrons that after leaving the premises they will be entering a No Alcohol Zone.

              3.              A lobbied entrance must be proved to avoid the transmission of sound.

              4.              Double glazing shall be installed to the front of the premises to avoid the transmission of sound.

              5.              The volume of sound used in connection of the music provided shall at all times be under control of the licensee or management and not accessible to the public.

              6.              Public car parks shall be available near by to avoid on street parking.

(e)              The Protection of Children from Harm

              1.              Persons under the age of 18 years must not be permitted on the premises. If in doubt, age verification should be asked for.
ANNEXE 3

CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
The Prevention of Crime and Disorder

1.              CCTV shall be maintained and used throughout the time that the premises are open and all recordings kept for a minimum of 14 days, during which time the police shall have access to them at any reasonable time.

2.              The premises shall join and participate in the Nitenet Radio Communications Scheme that operates within Torquay.

3.              That shall be no entry or re-entry to the Premises after 12.30am.

4.              All drinks promotions shall be managed in a responsible manner.

5.              On every occasion that the premises sells alcohol after midnight and remains open after 12.30am, SIA qualified door stewards shall be employed at the premises from 10pm until closing time.

6.              The ration of SIA door stewards shall be 1:100, based on occupancy.

7.              The Premises shall operate a closed door reception lobby but whenever a door steward leaves the premises and goes outside in the course of his/her duty, he/she must wear a high visibility reflective jacket.

8.              The Designated Premises Supervisor (DPS) or a member of staff shall attend that least two meetings per calendar year of the Torquay Licensing Forum Group.

9.              All drinks must be served in toughened, strengthened, polycarbonate or plastic glasses and whenever the premises serves alcohol after midnight and remains open after 12.20am, no drinks shall be served in glass bottles from which it is intended or likely that a person shall drink, from 10pm onwards.

10.              Any new member of staff employed at the Premise in the sale and supply of alcohol, shall hold a current BIIAB Level 1 Award in Responsible Alcohol Retailing.

11.              A record of all staff training, including copies of all relevant BIIAB certificates, shall be kept on the premises and be available to the police or local authority licensing officers for inspection upon demand. Such records to be kept at the premises for a minimum of 12 months.

12.              Notices regarding the sale of alcohol to persons who appear drunk shall be prominently displayed on the premises for the attention of all customers and staff.

13.              Any new Designated Premises Supervisor must hold or complete the BIIAB National Certificate within three months of being employed at the premise. A copy of such certificate must be produced to the Police forthwith.

14.              The DPS shall ensure that an incident book is kept on the premises and that all incidents are recorded therein on a daily basis. The incident book shall be made available for inspection by a police officer, a police licensing officer, on demand and such records to be kept at the premises for a minimum of 12 months.

15.              The Premises Licence Holder and/or Designated Premises Supervisor shall take all reasonable steps to ensure that patrons leaving the vicinity of the Premises do so quietly.
