CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
General
None
The Prevention of Crime and Disorder
1 As far as is practical, persons on or leaving the premises and using adjacent car parks and highways must be reminded to conduct themselves in an orderly manner and not in any way cause annoyance to residents or persons passing by.
2 A written drug policy shall be in force at the premises with the objective of securing, as far as is reasonably practicable, the safety of patrons and others attending the premises.
3 To prevent the sale of alcohol to persons under the age of 18 years, suitable written proof of age must be sought from young people attempting to purchase alcohol.
4 Bar staff must be suitably trained to prevent the sale of alcohol to under 18’s.
5 Regular glass and bottle collection must be undertaken throughout the premises.
6 Patrons must not be permitted to leave the premises with any glass or bottles which belong to the premises.
Public Safety
7 A logbook shall be kept on the premises in which shall be entered the particulars of any inspections made. This logbook must be kept available and produced for inspection when required by persons authorised by the Licensing Act 2003 or associated legislation.
8 Adequate access must be available for emergency vehicles.
9 All parts of the premises and all fittings and apparatus therein (door fastenings, notices, seating, lighting, heating, electrical, ventilation, sanitary accommodation, washing facilities and other installations) must be maintained at all times in good order and in a safe condition.
10 Suitable and sufficient lighting must be provided to the toilets.
11 Provision must be made for the collection and disposal of sanitary towels.
12 Suitable and sufficient ventilation must be provided for the toilets.
13 Where the licence permits the provision of dancing a suitable and clearly identifiable space must be available for this purpose. The minimum area to be set aside shall be four square metres where the licence permits a maximum capacity of between 1 and 99, six square metres where the licence permits a maximum capacity between 100 and 199 and nine square metres where the licence permits a maximum capacity of over 200.
14 An area separate from the main dance floor must be provided, containing adequate seating, suitable means of providing cool air and, as far as is practicable, respite from the high levels of noise produced.
15 At least one qualified first-aider shall be present on the premises during the whole time that the premises are available for regulated entertainment.
16 The date on which any staff have obtained first aid qualifications or received refresher training shall be recorded and kept within a logbook.
17 A responsible member of staff shall be designated to take charge of a situation, call an ambulance or administer first aid in the event of any patron or member of staff becoming badly injured or being taken seriously ill whilst on the premises.
18 Exits must be clearly and sufficiently identifiable, through use of suitable signage and illumination.
19 Before the public is admitted to the premises the management shall inspect or cause to be inspected all doors, exits and exit ways to ensure that they are free from obstruction, adequately lighted and that all fastenings and bolts are in good working order.
20 The word ‘PRIVATE’ or the description of the room to which the door leads must be painted in letters not less than 25mm in height on any door which is in view of the persons present and which does not lead to an exit.
21 Exit routes must be maintained free from obstruction at all times and in particular no provision for hanging clothing or storing any article must be made in corridors, passageways, gangways or exit ways.
22 Persons must not be allowed to stand, sit or otherwise remain in any gangway or exit way.
23 All doors and fastenings must at all times be kept in good working order.
24 Gangways, exit routes and steps must be maintained in good working order with non-slippery and even surfaces.
25 All floors, carpets and upholstery throughout the premises shall be thoroughly cleaned at regular intervals.
26 A suitably qualified and competent electrician must maintain the whole of the electrical installation system in good working order.
27 All temporary electrical installations must be disconnected from the permanent installation immediately after each occasion on which they are used. All wires, cables and conduits from such temporary installations must be installed in such a way that they shall not be liable to snagging, looping or damage and so become a danger to persons present.
28 Where entertainers require a three-phase supply only a competent electrical contractor shall install all such equipment.
29 The electrical system, including portable appliances, must be inspected and tested annually by a competent person to ensure their safety. The installation shall have a full inspection every three years and be tested annually. A competent person shall be defined as: ‘A qualified electrician who is qualified to complete works as per the IEE wiring regulations 16th Edition or is registered with the ECA or the NICEIC.’
30 All lighting to exit notices must be maintained in good repair and shall not in any circumstances be extinguished or dimmed whilst the public are on the premises.
31 All electric lamp holders within reach of a member of the public must be kept fitted with lamps or HIA bulbs or otherwise protected.
32 No portable heating appliances of any description must be used in the premises while the public is present.
33 All stoves, open fires and other heating appliances that form an integral part of the structure must be efficiently fixed and guarded.
34 If a fire is discovered or suspected the fire brigade must be called immediately. Any outbreak of fire, however small, must be recorded in a logbook.
35 All fire doors must be maintained effectively, self-closing and must not be held open other than by approved devices.
36 All fire resisting doors to ducts, service shafts and cupboards must be kept locked and shut.
37 Adequate arrangements must be in place for the safe evacuation of disabled persons in the event of an emergency. Disabled persons on the premises must be made aware of these arrangements.
32. Provision for disabled patrons shall be provided, where reasonably practicable for access and sanitary facilities.
The Prevention of Public Nuisance
38 Noise or vibration must not emanate from the premises such as to cause persons in the neighbourhood to be unreasonably disturbed.
39 The volume of amplified sound used in connection with the entertainment provided must at all times be under the control of the licensee/management and the controlling mechanism must be operated from a part of the premises not accessible to the public.
40 Noise levels within the premises resulting from the operation of any musical instrument or amplified equipment must be regulated so as to protect the hearing of any employee therein in accordance with current standards.
41 The placing of refuse, such as bottles, into receptacles outside the premises must take place at times that will prevent disturbance to nearby properties.
42 The Licensee must ensure that staff who arrive early in the morning or depart late at night when the business has ceased trading conduct themselves in a manner to avoid causing disturbance to nearby residents.
43 Suitable signage must be displayed at the exit to request the co-operation of patrons, in particular to make as little noise as possible when leaving the premises.
44 A specific taxi operator shall be nominated for staff and customer use and their telephone number advertised to customers. The operator and all drivers must be made aware that they should arrive and depart as quietly as possible, should not sound vehicle horns as a sign of their arrival or leave engines idling unnecessarily.
45 A senior member of staff must assess the impact of any noisy activities on neighbouring residential premises at the start of the activity/entertainment and periodically throughout the activity/entertainment to ensure levels of noise have not increased.
46 The handling of beer kegs, bottles and other similar items must not take place in the late evening, at night or during the early morning, when the noise generated could cause a nuisance particularly outside buildings.
47 The movement of bins and rubbish outside the premises must be kept to a minimum after 23:00hrs.
48 Staff shall monitor the use of the car park to ensure that patrons do not congregate in this area and cause annoyance.
49 The premises shall remain open for at least half an hour after the sale of alcohol has ceased, during which time patrons shall be gradually dispersed.
50 Cooking, noxious or persistent smells from the premises must not cause a nuisance to nearby properties and the premises shall be adequately ventilated.
The Protection of Children from Harm
51 Bar staff must be suitably trained to prevent the sale of alcohol to persons under the age of 18.
52 To prevent the sale of alcohol to persons under the age of 18 suitable written identification must be sought from young people attempting to purchase alcohol, in accordance with documents specified by Torbay Council’s ‘Statement of Licensing Policy’.
