General
1. Substantial food shall be available until the terminal hour for the sale by retail of alcohol.
2. Except when being used for a private function in the outside patio seating area and the area of the promenade licensed from Torbay Council, all intoxicating liquor shall be consumed by persons seated at tables and no alcohol shall be served in glass bottles from which it is intended or likely that a person shall drink.
The Prevention of Crime and Disorder
1. A CCTV system with recording facilities, including a monitor behind the serving counter, shall be maintained and used throughout the hours that the premises operate and recordings shall be kept for a minimum of 31 days during which time an authorised officer of the police shall have access to them at any reasonable time.
Public Safety
1. There shall be no more than 21 tables and 4 chairs per table on the promenade area which shall be operated in accordance with the provisions from time to time of the licence granted for use by Torbay Council, including a requirement that wine bottles shall be provided in wine coolers and for the provision of water in bottles.
2. The operators shall maintain third party insurance in a minimum cover of £5,000,000.
3. The nature and character and design of the tables and chairs must be approved by an officer of Torbay Council and removed from the area when required in the event of an emergency.
4. The area of the promenade shall be demarkated with ropes to the satisfaction of the appropriate officer of Torbay Council.
The Prevention of Public Nuisance
1. Noise or vibration shall not emanate from the premises such as to cause persons in the neighbourhood to be unreasonably disturbed. Noise should not be audible with any noise sensitive premises with windows open for normal ventilation, especially after 2300. The criteria applied from boundary to nearest residential property are:-
i) Before 2300 noise emanating from the premises shall not be clearly distinguishable above other noise.
ii) After 2300 noise emanating from the premises shall not be distinguishable above background levels of noise.
iii) The local authority shall reserve the right in cases of terminal noise and where premises are attached to others (i.e. semis and terraced properties) to make further assessments from within the residential property.
2. The following with amplified sound used in connection with the regulated entertainment provided must at all times be under the control of the licensee/management.
3. The promenade area shall be subject to a restriction in the licence that it must not be used in such a way as to cause any nuisance, damage, disturbance, noise, danger, inconvenience or interference to the adjoining property or to Torbay Council occupiers or users of the site or any adjoining or neighbouring property.
The Protection of Children From Harm
1. The management shall operate a proof of age policy and no child under 18 shall be permitted in the premiss unless accompanied by a responsible adult.
