The Prevention of Crime and Disorder
1. On any Thursday, Friday, Saturday and Sunday night that the premises remain open for the sale of alcohol after midnight and then closed after 0030, SIA door supervisors shall be employed on the premises from 2200 until close, at a ratio of 1 supervisor per 100 customers. (This condition shall also apply on Christmas Eve and New Years Eve when they do not fall on a Thursday, Friday, Saturday or Sunday.) On all other occasions, the premises licence holder shall risk assess the requirement for door supervisors and employ such door supervisors, if at all, in such numbers and at such times determined by that risk assessment.
2. CCTV shall be installed to the satisfaction of the police and will operate throughout the time the premises are open to the public and include recording facilities. Recordings shall be kept for a minimum of 14 days, during which time the police shall have access at any reasonable time.
3. The premises shall join and participate in the Nitenet Radio Communications Scheme that operates within Torquay.
4. All door supervisors deployed at the entrance(s) of the premises or externally shall wear high visibility reflective jackets or waistcoats for the entirety of their duty.
5. The premises shall join Torquay Night Time Economy Forum with the DPS or member of the management team having to attend at least two meetings per calendar year.
6. All drinks must be served in toughened, strengthened, polycarbonate or plastic glasses. On any Thursday, Friday, Saturday and Sunday night that the premises remain open for the sale of alcohol after midnight and then close after 0030, no alcohol shall be served in glass bottles from which it is intended or likely that customers shall drink, from 2200 onwards. This condition shall also apply on Christmas Eve and New Years Eve when they do not fall on a Thursday, Friday, Saturday or Sunday.
7. There shall be no offers of 'All inclusive' drinks promotions at the premises.
8. All drinks promotions shall be managed in a responsible manner.
9. No under 18 year olds shall be in the premises after 2200.
10. There shall be no entry or re-entry to the premises after 0200.
11. There shall be no consumption of drink (alcoholic or non-alcoholic) or food in the first floor terrace area after 0200. At all times after 0200 when the premises are open for licensable activities, an SIA registered door supervisor shall be employed at the entrance to the area to ensure compliance with the preceding restriction and to ensure that no authorised entrance to the premises takes place via the area.
The Prevention of Public Nuisance
1. Noise from the premises shall not be audible within any dwelling with windows open for normal ventilation especially after 2300. This shall be assessed from the boundary to the nearest residential properties on all sides of the licensed premises. The criteria that shall be applied are:-
(i) Before 2300 - Noise emanating from the premises shall not be clearly distinguishable above other noise.
(ii) After 2300 - Noise emanating from the premises shall not be distinguishable above background levels of noise.
(iii) The local authority shall reserve the right in cases of tonal noise and where premises are attached to others, to make further assessment from within the residential property.
2. No rubbish, including bottles, shall be moved, removed or placed in outside areas between 2100 and 0900.
3. Speakers shall not be positioned outside.
4. To allow live and amplified music inside doors and windows shall be kept shut during entertainment to reduce noise breakout. A management scheme shall be in place to ensure this situation remains.
