CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
General
1. Wish to promote the pub as a welcoming, safe and enjoyable environment for local trade. Families welcomed. Pub watch scheme to be joined.
2. All staff engaged in licensable activities at the premises will receive training and information in relation to each licensing objective as specified below.
3. Substantial hot food shall be available at all times (subject to a permitted wind-down period prior to closing).
The prevention of crime and disorder
1. All staff engaged in licensable activities at the premises will receive training and information in relation to the following:
i. The Challenge 25 scheme in operation at the premises, including the forms of identification that are acceptable.
ii. The hours and activities permitted by the premises licence issued under the Licensing Act 2003 and conditions attached to the licence.
iii. How to complete and maintain the refusal register in operation at the premises (in relation to the sale of alcohol).
iv. Recognising the signs of drunkenness.
v. The operating procedures for refusing service to any person who is drunk, under-age or appears to be under-age, or appears to be making a proxy purchase.
vi. Action to be taken in the event of an emergency, including reporting an incident to the emergency services.
Training shall be recorded in documentary form and shall be regularly refreshed at quarterly intervals. Training records shall be made available for inspection and copying at reasonable times upon request of an authorised officer of a responsible authority. Training records will be retained for at least 12 months.
2. An incident log will be kept and maintained at the premises which will include a log of the following, including pertinent details:
i. Any incidents of disorder or of a violent or anti-social nature
ii. All crimes reported to the venue, or by the venue to the police
iii. Any complaints received
iv. Any faults in the CCTV system
v. Any visits by a responsible authority (under the Licensing Act 2003) or emergency service.
Records must be completed within 24 hours of any incident, and will contain the time and date, the nature of the incident, the people involved, the action taken and details of the person responsible for the management of the premises at the time of the incident. The logs shall be kept for at least 12 months following the date of entry and be made available for inspection and copying upon request of an authorised officer of a responsible authority.
3. The premises shall operate and maintain a digital colour CCTV system to the satisfaction of the Police and Local Authority. As a minimum, the system must:
i. Cover the main public areas of the licensed premises, including entry and exit points, ground floor lounge and dining room.
ii. Record clear images permitting the identification of individuals and in particular enable facial recognition images (a clear head and shoulder image) of every person entering and leaving in any light condition.
iii. Continually record whilst the premises are open for licensable activities and during all times when customers remain on the premises.
iv. Have a constant and accurate time and date generation.
v. Store recordings for a minimum period of 14 days with date and time stamping.
vi. Viewable copies of recordings will be provided on request to the police and local authority officers as soon as is reasonably practicable and in accordance with the Data Protection Act 1998.
vii. The CCTV system will be capable of downloading images to a recognisable viewable format.
viii. The CCTV system will be fitted with security functions to ensure the integrity of the system and to prevent the tampering with and deletion of images (i.e. password protection).
4. The CCTV system will be fully compliant with the guidance contained in the Information Commissioner's Office (ICO) guidance document https://ico.org.uk/fororganisations/guide-to-data-protection/cctv/ (or any renewed equivalent guidance which is subsequently issued).
5. A staff member from the premises who is conversant with the operation of the CCTV system shall be on the premises at all times when the premises are open. This staff member must be able to provide an authorised officer of a responsible authority copies of recent CCTV images or data with minimal delay, or within 72 hours of the initial request.
6. An alcohol sales refusal register will be kept at the premises and be maintained to include details of all alcohol sales refused. The register will include:
i. the date and time of refusal
ii. the reason for refusal
iii. details of the person refusing the sale
iv. any known information about the customer
v. any other relevant observations.
The refusals register will be made available for inspection and copying on the request of an authorised officer of a responsible authority. All entries must be made within 24 hours of the refusal.
7. The DPS and/or the premises licence holder will be responsible for conducting dynamic risk assessments for the requirement of SIA licensed door staff especially during busy periods, public holidays, or any other events such as sporting events or festivals.
8. A written drugs policy will be in place and operated at the premises. It must detail the actions taken to minimise the opportunity to use or supply illegal substances within the premises. The policy must be made available for inspection and copying upon request by an authorised officer of a responsible authority.
9. No drinking vessel, glass or bottle may be taken from the premises.
Public safety
1. All areas to be adequately lit.
2. Toilets and outside areas to be regularly patrolled by staff.
3. Regular tours of premises by staff to ensure all areas, including toilets, are well maintained and no members of the public are engaging in unwanted behaviour.
4. Staff to be trained in minimising risk of violence and all areas to be well lit.
5. Notices stating that there is a zero tolerance towards drugs on the premises resulting in immediate ban if discovered.
The prevention of public nuisance
1. During the final hour of trading appropriate announcements will be made or images projected to remind patrons of the need to leave the premises quietly without causing annoyance, nuisance or disturbance to local residents and to advise patrons of any taxi free-phone or collection arrangements available upon the premises.
2. Clear and legible notices shall be prominently displayed at all exits requesting patrons to respect the needs of local residents and businesses and to leave the vicinity as quickly and quietly as possible.
3. Suitable receptacles will be provided for cigarette litter outside.
4. The outside area shall be regularly cleaned to ensure that all discarded smoking litter is removed and properly disposed.
5. The outside seating area must be closed and cleared of customers (except smokers) by 21:00 hours. No drinks are to be taken into the outside area after 21:00 hours. Adequate notices shall be displayed to inform patrons of this requirement.
6. The outside area will be restricted after 21:00hours to 5 customers (for smoking only).
7. The outside area shall be routinely monitored after 21:00 hours and any patron causing a nuisance shall be asked to come inside the premises, and where they refuse to do so, they shall be asked to leave the premises immediately.
8. All external doors and windows must be kept closed after 23:00 hours.
9. The placing of refuse, such as bottles into receptacles within the premises outside areas, shall not take place between 21:00 hours and 09:00 hours.
10. The premises licence holder(s) or designated member of staff will liaise with immediate properties in the event of any noise related issues/complaints to ensure any noise issues are dealt with.
11. There shall be a minimum of two members of staff on the premises from 21:00 hours until the premises close on a Friday and Saturday.
The protection of children from harm
1. The Challenge 25 scheme in operation at the premises, including the forms of identification that are acceptable. Challenge 25 posters to be erected around bar areas.
2. All staff trained to ensure no children are served alcohol.
3. No 16/17 year olds to be permitted consumption of alcohol (when with an adult).
4. Families and children are welcomed up to 21 :00 (every night).
5. Implement a strict no proof (of over 18 yrs) no sale or consumption policy.
6. There will be in place a written age verification policy in relation to the sale or supply of alcohol, which will specify a Challenge 25 proof of age requirement. This means that staff working at the premises will ask individuals who appear to be under 25 years of age, attempting to purchase alcohol, to produce identification. The only acceptable identification documents will be:
- A photo driving licence
- A passport
- An identification card carrying the PASS hologram
Unless such identification is produced the sale of alcohol must be refused. This policy will include documented steps taken to prevent adults from purchasing alcohol for or on behalf of children under 18.
