CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Additional Conditions Transferred from the Licence
1) Suitable beverages other than intoxicating liquor, including drinking water, shall be equally available for consumption on the premises.
Conditions transferred from Operating Schedule
(a) General
1) The applicants must ensure that the premises do not become overcrowded; the provision of meals and table space for the same assist in checking occupancy.
2) The applicants must ensure orderly conduct.
3) The hours for which the premises will be open must be clearly displayed with confirmation of times for the supply of alcohol and late night refreshment.
4) The premises must be adequately lit, ventilated and all fire precautions must be observed.
5) The premises are currently suitable for the purpose and there must be no digression from that purpose.
(b) The Prevention of Crime and Disorder
1) The applicant must install CCTV capable of covering the inside of the premises. CCTV must be maintained in good working order. The monitor must be behind the bar and/or in the applicant's office with either tape or digital information held for 31 days.
2) An incident book and recorded details of all incidents or public disorder must be kept.
3) Staff must be and are trained to vigilant and regularly supervise the premises indoor and out to check orderly conduct.
4) Proof of age must be asked for and necessary for the supply of alcohol to patrons.
5) Food must be available throughout the period that the premises are open as must non-alcohic drinks including hot drinks.
6) The restaurant area on the first floor must be covered by CCTV. Staff must visit the first floor when in use on a regular basis to supervise in addition to CCTV (the first floor shall be mainly used for booked parties).
7) The premises must provide tables and chairs for sitting accommodation for those persons taking meals.
(c) Public Safety
Workplace Regulations
1) The fire safety measures with which the premises are provided, must be maintained in good working order and their adequacy will be determined on a regular basis by the carrying out of a fire risk assessment as required by and in accordance with the fire precautions (workplace) regulations.
Fire Safety (checklist)
1) All exit doors must be easily openable without the use of a key, card, code or similar means and must be available for egress while the public are on the premises.
2) Means of escape must be maintained, unobstructed, immediately available and identifiable.
3) Exit doors must be regularly checked to ensure they function satisfactorily.
4) Records of these checks must be kept and produced on request.
5) Any removable security fastenings must be removed whenever the premises are open to the public or staff.
6) All gangways, exit routes and steps must maintain non-slippery and even surfaces.
7) All floor coverings will be secured and maintained so that they will not ruck.
8) Hangings/curtains and temporary decorations must be maintained in flame-retardant condition.
9) Upholstered seating must be fire-retardant and must comply with current fire safety regulations.
10) Curtains, hangings and temporary decorations must not obstruct exits.
11) Fire safety signs or fire fighting equipment notices detailing any actions to be taken in the event of fire or other emergency must be properly displayed and maintained in good condition.
12) Access must be provided for emergency vehicles and this access must be kept clear and free from obstruction.
13) An evacuation policy must be in place which is to the satisfaction of the fire authority. All staff members must be trained in the evacuation policy.
14) Exit doors must open outwards (or shall be secured in the open position).
15) Fire alarms, fire fighting equipment is serviced and tested annually by an approved contractor.
Electrical System
1) The electrical system must be inspected and tested annually by a competent person to ensure safety.
2) Where temporary electrical equipment is to be used, a suitable circuit breaker device must be installed to cover this equipment. The circuit breaker should operate at a current not exceeding 30 MA and should comply with BS 4293. The device must be tested monthly and tests must be recorded.
3) Temporary electrical wiring and distribution systems will not be installed unless inspected by a suitable qualified electrican. Temporary electrical wiring and distribution systems will comply with BS 7671 or where applicable BS 7909.
Gas System
1) The gas system including appliances will be inspected and tested by Corgi Registered Gas Engineer annually and a satisfactory gas safety certificate will be obtained. All safety certificates and inspection reports will be kept on site and made available for inspection by officers of relevant statuatory bodies.
Disabled Persons
1) When disabled people are present, adequate arrangements must exist to enable their safe evacuation in the event of an emergency. Review and assessment of accessibility in line with the Disability Discrimination Act is complete and kept on the premises.
Sanitary Accommodation:
Consists of: 2 Female WCs, 2 Femaile Wash Hand Basins
1 Male WC, 1 Male Urinal and 1 Male Wash Hand Basin
CCTV will be in operation in areas not visible from the bar area.
First Aid
1) The applicants must ensure there are adequate first aid arrangements at all times. The applicants arrangements for first aid provision include a first aid box, an adequate and appropriate supply of first aid provision include a first aid box, an adequate and appropriate supply of first aid equipment and materials to be used by patrons. Suitable proective equipment will be provided to deal with hypodermic needles, blood spillages and other body fluids. Procedures shall be in place to ensure that body fluids are dealt with in a safe manner to avoid the risk of communicable diseases.
2) Gangways, exit routes and steps will be maintained in good order with non-slippery surfaces; edges of steps and stairwells will be conspicuously marked.
(d) The Prevention of Public Nuisance
Noise
1) Noise or vibration must not emanate from the premises such as to cause persons in the neighbourhood to be unreasonably disturbed.
2) Sufficient ventilation must be provided so as to ensure that doors and windows can be kept closed, where possible.
3) Suitable signage at all relevant exist requesting that patrons make as little noise as possible when leaving the premises must be displayed.
4) Patrons shall be asked not to stand around talking in the street outside the premises or any car pak; and asked to leave the vicinity quickly and quietly.
5) An announcement shall be made prior to closing requesting patrons' co-operation in leaving the premises and vicinity as quietly and quickly as possible.
Noise from Plant and Machinery
1) Provision of mechanical ventilation and air conditioning systems must not allow noise breakout from premises or cause a nuisance by its operation. Where plant and machinery has the potential to cause a noise problem it will be positioned in such a way that the building structure provieds as much screening as possible for nearby noise - sensitive properties. Alternatively, or additionally, control measures such as acoustic enclosures, acoustic louvres, silencers, or accoustic screening must be considered.
2) Regular maintenance must be carried out on plant and machinery to ensure that noise disturbance from such sources is kept to a minimum.
Delivery/Collection/Storage Facilities
1) The delivery of goods is restricted to between 8.00am and 5.00pm.
2) The handling of beer kegs, bottles and other similar items must not take place in the late evening, at night and during the early morning, when the noise generated could cause a nuisance particularly outside buildings.
3) Bottle skips and bins containing cans or bottles must not be emptied outside after closing but must be dealt with the next day during normal office hours (save as for Sundays and New Years Day).
4) The movement of bins and rubbish outside the premises must be kept to a minimum/oprohibited after 5.00pm.
Use of Outside Areas
1) Management must ensure that the outside area is cisited frequently during opening hours to ensure non disturbance to neighbours.
Extraction Systems
1) Extraction systems cleaned and minimalised levels of odour.
Refuse, Litter & Waste
1) All the rubbish produced by the premises shall be stored securely to prevent litter being blown around.
(e) The Protection of Children from Harm
1) A proof of age policy agreed by the police and local authority must be enforced.
2) Children only allowed on the premises and in the outside areas with an adult and must be supervised at all times.
Restrictions transferred from the On Licence
The restrictions related to permitted hours do not prohibit:
(a) during the first twenty minutes after the above hours the consumption of the alcohol on the premises;
(b) during the first twenty minutes after the above hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken in an open vessel;
(c) during the first thirty minutes after the above hours the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals;
(d) consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the licensed premises;
(e) the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
(f) the sale of alcohol to a trader or club for the purpose of the trade or club.
(g) the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
(h) the taking of alcohol from the premises by a person residing there; or
(i) the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
(j) the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of alcohol so supplied, if the liquor is supplied at the expense of the employer or of the person carrying on or in charge of the business on the premises.
Credit Sales
Alcohol shall not be sold or supplied unless it is paid for before or at the time when it is sold or supplied, except alcohol sold or supplied:
(a) with and for consumption at a meal supplied at the same time, consumed with the meal and paid for together with the meal;
(b) for consumption by a person residing in the premises or his guest and paid for together with his accommodation;
(c) to a canteen or mess.
