  ANNEXE 1

   

  MANDATORY CONDITION: WHERE LICENCE AUTHORISES SUPPLY OF ALCOHOL

   

  1)              No supply of alcohol may be made under the premises licence:-
   

  ()        at a time where there is no designated premises supervisor in respect of the premises licence, or
   

  ()        at a time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended.

   

  2)              Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  3)              (1) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.

   

  (2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.

   

  (3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either:-

   

  (a) a holographic mark, or

   

  (b) an ultraviolet feature.

   

  4)              A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.

  ANNEXE 2

   

  CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  General

   

  1.              There shall be a clear and legible sign outside and inside of the premises indicating sales of alcohol permitted.

   

  2.              CCTV shall be stored inside and outside of premises and images shall be saved for 14 days.

   

  3.              Clear sign of age restriction on supply of alcohol shall be placed.

   

  4.              "No ID no sale" signs shall be displayed next to alcohol.

   

  5.              The Premises licence holder will employ a company, approved by TBC Trading Standards, to carry out a test purchase of alcohol on 3 occasions over a period of 12 months. If the premises fails a test purchase within the 12 month period, the premises will retain the company for an additional 12 months to carry out 3 further test purchases. If all 3 test purchases are successful within the first 12 month period, this condition shall cease thereafter.

   

  6.              The premises licence holder will notify Torbay Council's Trading Standards Department of the result of each test purchase within 5 working days of the test purchase taking place.

   

  The Prevention of Crime and Disorder

   

  1.              Recording CCTV shall be stored.

   

  2.              "No confrontation" policy shall be in place.

   

  3.              Local police shall be made aware of possible sign of crimes.

   

  Public Safety

   

  1.              Clear "fire exit" sign shall be used and fire extinguisher shall be stored and regularly checked.

   

  2.              Clear sign for public indicating CCTV system shall be in place in these premises.

   

  3.              First Aid Box shall be kept at premises at all times.

   

  4.              All fixtures and fittings shall be fixed securely.

   

  The Prevention of Public Nuisance

   

  1.              No louder music shall be played at the premises are all times.

   

  2.              No deliveries shall be made after 21.00.

   

  The Protection of Children from Harm

   

  1.              There shall be a clear sign of age limit to buying alcohol.

   

  2.              No ID no sale policy shall be in place.
