  MANDATORY CONDITION:  EXHIBITION OF FILMS

   

  1)       Where the film classification body is specified in the licence, admission of children must be restricted in accordance with any recommendation made by that body.

   

  2)       Where -

   

  ()        the film classification body is not specified in the licence, or
   

  ()        the relevant licensing authority has notified the holder of the licence that this condition applies to the film in question,
   

  admission of children must be restricted in accordance with any recommendation made by that licensing authority.

   

  In the case of the aforementioned conditions

                “children” means persons aged under 18; and

                “film classification body” means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (authority to determine suitability of video works for classification).

  ANNEXE 2

   

  CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

•  

  The Prevention of Crime and Disorder

   

  1.              Parkfield must have site supervision at all times.  During busy times staff shall be required to patrol the site.  During out of hours Torbay Council Security Team and the police will patrol the site.

   

  2.              CCTV cameras must be placed at the front and back of both buildings and monitored by Torbay Council Security Team.

   

  3.              Groups of young people who are known to the local authority for anti-social behaviour shall be on site but will have extensive staff supervision and heavily involved in planned activities.

   

   

  Public Safety

   

  1.              Normal and Emergency operating procedures shall be put in place.  An events plan will be put in place for Individual events, including risk assessments.  Torbay Council's Emergency Planning Office shall be involved in all major events.

   

  2.              Patrols and inspections of site and equipment shall be done regularly throughout the day, recorded and monitored.

   

   

  The Prevention of Public Nuisance

   

  1.              Staff shall be trained in dealing with all public nuisance incidents.  The accommodation unit shall have someone based on site throughout the night.  Policies and procedures shall be put in place with persistent offenders being removed from the premises and a period of non-entry to the site would be put in place.

   

  2.              Additional path lights must be switched off once the facility is shut in the evening.  Bins must be placed in a secure area and must be emptied regularly.  Noise levels (as requested by a planning condition) will be kept to a minimum through the landscape design and site patrols (acoustic barriers).

   

   

  The Protection of Children from Harm

   

  1.              Parkfield must have site supervisors at all times.  All staff shall have enhanced CRB checks.  All staff shall be trained in issues relating to the 'safeguarding of children' and child protection.  Training shall be ongoing and will include all aspects of young people's safety including drug and alcohol issues, bullying, self esteem/self confidence etc.

   

  2.              All staff patrolling the site must be first aid trained.  First aid boxes must be placed in the new and old buildings.

  ANNEXE 3

   

  CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY

   

•  

  The Prevention of Public Nuisance

   

  1.               Noise or vibration shall not emanate from the premises such as to cause persons in the neighbourhood to be unreasonably disturbed.  In general terms, noise from the premises should not be audible within any noise sensitive premises (e.g. dwelling) with windows open for normal ventilation especially after 11pm.  This shall be assessed from the boundary to the nearest residential properties, on all sides of the licensed premises.  The criteria that shall be applied are:

                i.              Before 11pm - Noise emanating from the premises shall not be clearly distinguishable above other noise.

                ii.              After 11pm - Noise emanating from the premises shall not be distinguishable above background levels of noise.

                iii.              The local authority shall reserve the right in cases of tonal noise and where premises are attached to others (i.e. semi's and terraced properties), to make further assessments from within the residential property.

   

  2.              The volume of amplified sound used in connection with the entertainment provided shall at all times be under the control of the Licensee/Management and the controlling mechanism shall be operated from a part of the premises not accessible to the public.

   

  3.              Patrons shall be asked not to stand around talking in the street outside the premises or any car park, and asked to leave the vicinity quickly and quietly.
