General
1. All staff shall be sent to obtain Personal Licences to adopt Council Laws, Policies and Procedures for the training of staff in the sale of alcohol.
2. The premises shall be supervised at all times that the premises are open to the public.
3. There shall be on the premises at all times that alcohol is being sold, a senior member of staff being either the proprietor, a manager, assistant manager or other senior member of staff.
4. No fewer than two members of staff shall be on the premises when alcohol is for sale. If there are occasions when there are less than the above numbers, alcohol shall not be sold to the public.
The Prevention of Crime and Disorder
1. A CCTV system must be installed (two outdoor cameras, one at each side of the shop front and six inside the shop).
2. The CCTV system must be in operation at all times and shall be of evidential standard.
3. All CCTV recordings shall be kept for 14 consecutive days and the police shall have access to the recordings if needed at any time.
4. Suitable signage informing people that CCTV is in operation shall be displayed.
5. CCTV shall be installed and maintained with tapes or their equivalent being kept for 14 days and made available for inspection by the police.
6. Staff shall be trained in the Trade Fair Plus Ltd Policy "to sell or not to sell".
7. Alcohol shall be secured in a secure storeroom as shown on plan.
8. The alcohol shall be restricted to the area as shown on Plan Enclosed. There will be no alteration to the area used for the display of alcohol without prior consultation with the police and with the licensing authority's officers.
9. Signage shall be prominently displayed to confirm that:
(a) No alcohol shall be sold or supplied to any persons who are intoxicated.
(b) No alcohol shall be sold or supplied to persons who are under 18 years of age and proof of age must be provided if requested.
10. Further signage shall be provided confirming the offences in relation to the purchase for and on behalf of children and by children under the Licensing Act 2003.
11. Tills shall be adjacent to the off-licence area for greater supervision.
12. Outside of the hours for the sale of alcohol, or in the vent of insufficient members of staff on the premises, the off-licensed area shall be closed to patrons and indicated as closed by the use of roller blinds.
13. The following lines of alcohol shall not be sold from the premises:-
Alco-pops - Bacardi Breezer range, Red Square range, VK range, WKD range.
Super-strength lager, Carlsberg Special Brew, Tennants Super.
Cider - Not to stock any 2 litre and 1 litre plastic bottle ciders.
14. The sale of all spirits shall be by way of counter service only.
15. The premises shall join and maintain membership of the local Storenet/Nitenet Radio Communications Scheme which shall be monitored by staff at all times the premises are open to the public.
16. The Designated Premises Supervisor shall ensure that a Refusals Register, recording refused sale of alcohol, is kept and maintained on the premises at all times. The police shall have access to this Register at any reasonable time.
Public Safety
1. All staff shall receive suitable training about what to do in an emergency and in general safety precautions.
2. A log book shall be kept upon the premises in which shall be entered particulars of inspections made, those required by statue, and information compiled to comply with any public safety condition attached to the premises licence that requires the recording of such information.
3. The logbook shall be kept available and produced for inspection when required by persons authorised by the Licensing Act 2003 or associated legislation.
4. Suitable signage such as (No Drinking Zone), there shall be clear legible notice by the door of the premises.
5. Fire alarm must be installed and maintained.
6. Workplace regulations (for the premises where persons are employed) the fire safety measures with which the premises are provided, shall be maintained in good working order and their adequacy shall be maintained in good working order and their adequacy shall be determined on a regular basis by the carrying out of the fire risk assessment as required by, and in accordance with, the Fire Precautions (Workplace) Regulations.
7. First Aid - there shall be adequate first aid arrangements at all times. The arrangements for first aid provision shall include a first aid box, an adequate and appropriate supply of first aid equipment and materials to be used by patrons. Suitable protective equipment shall be provided to deal with hypodermic needles, blood spillages and other body fluids. Procedures shall be in place to ensure that body fluids are dealt with in a safe manner to avoid the risk of communicable diseases.
The Prevention of Public Nuisance
1. Noise or vibration shall not emanate from the premises such as to cause persons in the neighbourhood to be unreasonably disturbed. In general terms, noise from the premises should not be audible within any noise sensitive premises with windows open for normal ventilation especially after 11pm. This shall be assessed from the boundary to the nearest residential properties, on all sides of the licensed premises. The criteria that shall be applied are:-
- Before 11pm - Noise emanating from the premises shall not be clearly distinguishable above other noise.
- After 11pm - Noise emanating from the premises shall not be distinguishable above background levels of noise.
2. Deliveries of food or other materials necessary for the operation of the business shall be carried out at such a time or in such a manner as to prevent nuisance and disturbance to nearby residents.
3. All staff shall have received suitable training as to what to do in an emergency and in general safety precautions.
4. Prominent, clear and legible notices shall be displayed at all exits requesting the public to respect the needs of local residents and to leave the premises and the area quietly (no drinking zone).
5. Delivery/collection/storage facilities - the delivery of goods shall be restricted to the following times: between 07.00 and 18.00 hours.
The Protection of Children from Harm
1. Children below the age of 18 shall be excluded from the premises between the hours of 23.00 to 05.00.
2. Adult magazines shall be placed on top shelves of the magazine stand with clear signage stating the age restriction.
3. Alcohol and tobacco shall be behind and next to the counter.
4. There shall be suitable signage indicating (No ID No SALE, Challenge 21 policy, list of ID's accepted as valid).
5. There shall be suitable and ongoing training of the staff about alcohol sale policy to under 18's, and shall keep a record of training with signatures of each member or staff.
6. There shall be a refusals register to record sales when customer unable to produce a valid photo-ID and therefore the sale refused.
7. Alcohol shall not be sold or supplied to persons who cannot prove that they are over 18.
8. There shall be no children's toys or groceries other than crisps, peanuts and alcohol food accessories in the area described as the "off-licence area".
