ANNEXE 1
MANDATORY CONDITION: WHERE LICENCE AUTHORISES SUPPLY OF ALCOHOL

1)       No supply of alcohol may be made under the premises licence:-

()        at a time where there is no designated premises supervisor in respect of the premises licence , or

()        at a time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended.

2)              Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
ANNEXE 2

CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The prevention of crime and disorder

1.              A CCTV system of an evidential standard must be installed to the satisfaction of the police and the system shall be kept in operation at all times the premises are open to the public. All recordings from that system are to be kept for a period of 31 days and the police shall have access to recordings at any reasonable time.

2.              The premises shall join and maintain membership of the Nitenet Radio Communication scheme.

3.              Service of alcohol shall be by waiter/waitress service and customers shall be seated.

4.              Persons in the restaurant area may purchase alcohol only for consumption with a table meal.

5.              When alcohol is served past 12am, a door steward shall be on duty from 9pm until closing (2.30am)

Public safety

None

The prevention of public nuisance

1.              Placing of refuse into receptacles outside the premises shall take place at times that will prevent disturbance to nearby properties.

2.              Deliveries of beer kegs, bottles and other similar items must not take place in the late evening or at night.

3.              Live music shall be kept mainly in the restaurant which is situated at the rear of the building.

The protection of children from harm

1.              Young people who appear to be under the age of 21 shall be asked for age identification before they are served alcoholic drinks.

2.              Proof of age shall normally be required by reference to one of the following:-
              i.              Passport
              ii.              EU photo card driving licence
              iii.              Proof of Age Standards Scheme (PASS) card
              iv.              A CitizenCard, supported by the Home Office
              v.              An official identity card issued by HM Forces or by a European Union country bearing a photograph and the date of birth of the bearer.
ANNEXE 3

CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
The Prevention of Crime and Disorder

1.              All drinks shall be served in toughened or strengthened glasses and no alcohol shall be served in glass bottles from which it is intended or likely that a person shall drink.

2.              There shall be no entry/re-entry to the premises after 12.00 midnight.

3.              On every occasion that the premises sells alcohol after midnight and then closes after 12.30am, SIA door staff shall be employed from 10.00pm until closing.

The Prevention of Public Nuisance

1.              Cooking, noxious or persistent smells from the premises shall not cause a nuisance to nearby properties and the premises must be properly vented.

2.              Noise from the premises, or from activities directly associated with the premises (e.g. noise from queues or external smokers), shall not be audible within any dwelling with windows open for normal ventilation especially after 11pm. This shall be assessed from the boundary to the nearest residential properties, on all sides of the licensed premises. The criteria that shall be applied are;

              (i)              Before 11pm - noise emanating from the premises shall not be clearly distinguishable above other noise.

              (ii)              After 11pm - noise emanating from the premises shall not be distinguishable above background levels of noise.

              (iii)              The local authority shall reserve the right in cases of tonal noise and where premises are attached to others, to make further assessments from within the residential property.

3.              The DPS shall ensure that noise shall not emanate from the premises such as to cause persons in the neighbourhood to be unreasonably disturbed. To this end, adequate measures shall be undertaken to prevent the above to the satisfaction of the Environmental Health Department of Torbay Council. Measures shall take the form of either;

              (i)              Specific acoustic insulation to all facade windows and doors or

              (ii)              Control of the distribution of internal sound amplification equipment and speakers so as to prevent breakout of noise from regulated entertainment through the building facade. This will include the use of premises speakers to be limited to 80 watts and no more than 16 in number.

              (iii)              Visiting artists speakers are not to be used in any upper ground floor area of the premises and to be positioned a minimum 15 metres from, and at all times facing, the rear wall of the premises.

4.              The volume of amplified sound used in connection with the entertainment provided shall at all times be under the control of the DPS or Management and the controlling mechanism shall be operated from a part of the premises not accessible to the public.

5.              All windows and doors shall be closed during periods of regulated entertainment.

6.              Entrances must be provided with lobbies with automatic door-closers. The lobbies are in use throughout the time of entertainment.

7.              A senior member of staff (manager) shall assess the impact of any noise activities on neighbouring residential premises at the start of the activity/entertainment and periodically throughout the activity/entertainment to ensure levels of noise have not increased.
