  MANDATORY CONDITION:  WHERE LICENCE AUTHORISES SUPPLY OF ALCOHOL

   

  1)       No supply of alcohol may be made under the premises licence:-
   

  ()        at a time where there is no designated premises supervisor in respect of the premises licence , or
   

  ()        at a time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended.

   

  2)              Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

  ANNEXE 2

   

  CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

• General

   

  1.              The premises must by law have a certificate issued by the MCA in order to operate.  Part of the passenger certificate is to comply with the domestic safety management code.  This means the safety management system must include as follows:

   

                        Ship construction (e.g. hull construction, stability and survivability, fire protection, emergency escape routes)

                        Maximum number of passengers carried

                        Safe means of access

                        Safety equipment (e.g. fire fighting, life saving appliances, lifejackets)

                        Navigation safety

                        Manning levels and training of skipper and crew.  Safety training

                        Operating limits

                        Health and Safety

                        Recording passenger numbers

                        Safety announcements for passengers

                        Co-operation with emergency services

                        Search and rescue plans.

                        Emergency procedures.

   

  The Prevention of Crime and Disorder

   

  1.              As a domestic passenger ship there must be a 'safe capacity' limit. 

   

  2.              The effects of violence shall be reduced through the use of drinking glasses and bottles by promoting the use of plastic glasses.

   

  3.              Alcohol sales shall be ended 30 minutes prior to disembarkation of the ship.

   

  4.              There shall not be heavily discounted drinking promotions.

   

  5.              The premises shall reduce the risk of excessive alcohol consumption by providing reasonably priced soft drinks.

   

  Public Safety

   

  1.              The risks to the public and staff shall be assessed while embarking and disembarking as stated in the shop safety management system.

   

  2.              The premises shall ensure that the number of passengers and staff onboard can safely evacuate in the event of an emergency.

   

  3.              There shall be adequate staff training to deal with emergencies.  The training log books onboard ship show the frequency the staff training takes place.

   

  4.              Controlled entry to the shop shall be counted by using the 'clicker' system as approved by the MCA.

   

  The Prevention of Public Nuisance

   

  1.              The premises shall prevent noise and vibration escaping from the vessel when in vicinity of the harbours by having all watertight doors shut.  Sound at sea when cruising shall               be contained.

   

  2.              No light disturbances shall interfere with residents or other businesses as the ship is moored at the end of a long pier.

   

  3.              When guests leave the ship they shall be asked to do so quietly.

   

  The Protection of Children From Harm

   

  1.              If a person looks under 21 they shall be asked for ID.  Suitable forms of ID include:  passport, photo card driving licence,  Proof of age standards scheme (PASS).  Alcohol shall not be served to anyone who cannot produce ID.

   

  2.              Children of any age shall be allowed on the vessel and in the bar area.   No children under 16 shall be allowed on the vessel without an accompanying adult.  In respect of large groups of chidlren i.e. school parties teacher: pupil ratios must be observed.

   

  3.              Smoking must not be permitted in any part of the inner saloon or top sundeck area.  Smoking shall be permitted on the stern deck only.

   

  4.              All scheduled daytime and evening cruises shall be family oriented.  Private bookings must complete and sign a booking form.

  ANNEXE 3

   

  CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY

   

•  

  The Prevention of Crime and Disorder

   

  1.              Whenever the vessel is moored adjacent to land, the sale and supply of alcohol shall be restricted to persons attending pre-booked functions and persons attending table meals.

   

  The Prevention of Public Nuisance

   

  1.              Noise from the premises shall not be audible within any dwelling with windows open for normal ventilation.  This shall be assessed from the boundary to the nearest residential properties, on all sides of the licensed premises.  The criteria that shall be applied are; 

                Noise emanating from the premises shall not be clearly distinguishable above other noise.  The local authority shall reserve the right in cases of tonal noise and where premises are attached to others, to make further assessments from within the residential property.

   

  2.              A senior member of staff (manager) shall assess the impact of any noisy activities on neighbouring residential premises at the start of the activity/entertainment and periodically throughout the activity/entertainment to ensure levels of noise have not increased.

   

  3.              Noise disturbance from all plant and machinery shall be kept to a minimum.
