ANNEX 2
CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
General
1. CCTV Will be installed to monitor arrivals and departures at the club main door.
2. Club Management, Steward(ess) and other bar staff will be informed of the Licensing Act 2003 objectives and statutory requirement to comply with all the relevant provisions of the act.
The Prevention of Crime and Disorder
1. Club consititution includes rules governing the conduct of members and their guests within and adjacent to the club premises.
2. Admission to the club wll be confined to members and bona-fide guests.
3. Guests arriving unaccompanied will be scrutinised before admission and signing in by bhe host member.
4. Club employees will be instructednot to admit or serve members and guests who behave in a drunken or disorderly fasion.
5. Misconduct will be reported to the committee to consider action under the clubs disciplinary code.
Public Safety
1. The club shall comply with Health & Safety & Fire Precautions legislation.
2. Following risk assessment, preventions and control measures will be in place to ensure the safety of members, guests, employees and entertainers whilst on the premises.
3. The club shall comply with advised capacity limits.
4. Fire action notices will be posted as will emergency escape routes.
The Prevention of Public Nuisance
1. Signage will be displayed near exists requesting members and guests to respect the needs of local residents by quietly leaving the premises.
2. When live or recorded music is played, all reasonable steps will be taken to avoid disturbance to neighbouring properties.
3. All bottle disposal will be carried out in daylight hours.
4. All rubbish produced will be placed in secure bins.
5. Stereo/television or other audio equipment speakers must not be mounted in or from the ceilings of the premises to prevent vibration transmission off sound energy to adjoining properties.
6. Audio speakers or similar must not be wall mounted to prevent vibration transmission off sound energy to adjoining properties.
7. Audio speakers or similar must not be positioned on the stage. Instead all speakers must be kept on the concrete floor using audio isolator speaker stands or similar.
8. Musicians who use drums or back line equipment must not perform at the premises until further sounds insulations works are completed.
9. A sound limiting device must be installed in the premises.
10. The sound limiter device must be set at a level by a suitably qualified person and in consultation with Torbay Council Licensing Team.
11. If substantiated noise complaints cannot be resolved by use of the sound limiter then amplified entertainment must cease until such times as sound insulation is installed in the premises.
12. No adjustments to the noise limiting device or any associated public address equipment shall be made without prior consultation with Torbay Council licensing team. A minimum of 7 days notice must be given in writing.
13. No independent sound system or similar shall be brought on to the premises and used for amplified entertainment within the premises.
14. All performers must use the noise limiting device and the premises in house public address system.
15. The noise limiter must not be overridden or interfered with at any time.
16. A sign advising musicians a limiter is in operation at the premises and that they must use it should be clearly displayed.
17. Where contacts are drawn with musicians it should be explicit in the terms of conditions a noise limiter is in use at the premises and must be used by the musicians at all times.
18. All members of the committee must be trained on how to use the in house amplification equipment. Checking musicians are using the limiter must form part of the training.
19. A nominated committee member must make appropriate checks before and during entertainment to ensure musicians are correctly using the noise limiting device.
20. A written noise management policy and procedures must be kept on site and available for inspections by appointed Officer on reasonably request.
21. The noise management policy and procedure must be reviewed annually at a committee meeting or when substantial changes are made to the public address system or the fabric of the building.
The Protection of Children from Harm
1. Persons under the age of 18 will only be allowed in the club if accompanied.
2. Accompanied children and grandchildren of members may be admitted to the snooker room for tuition.
3. Door control ensures that children seeking admission to the club for any purpose are accompanied by an adult member.
4. Young adults applying for membership must satisfy the committee that they are over 18, if necessary by producing proof of age.
5. Accompanied children and grandchildren of members and their guests may attend a private party in the function room.
6. Committee members, the club steward(ess) and other members of staff will be instructed in the offence provisions of the Licensing Act 2003 relating to alcohol and the protection of children.
7. Signage will be posted at the bar servery prohibiting the direct or indirect supply or delivery of alcohol to children.
8. The challenge 21 initiative will be operated within the premises and appropriate notices displayed.
