General
1 The maximum occupancy figures for the clubhouse will be 650 in agreement with the Licensing Authority and Devon Fire and Rescue and based upon fire safety issues, available floor space and the sanitary accommodation available.
2 Last entry times to the premises must be 23:00hrs on Sunday to Wednesday and 00.00hrs Thursday to Saturday.
3 Irresponsible drink promotions must not be permitted.
4 Customers carrying open or sealed bottles or glasses must not be admitted to the premises at any time.
5 Customers must not be permitted to take open containers of alcoholic or soft drinks from the premises.
6 All bottles and glasses must be removed from public areas as soon as they are finished or empty.
7 An anti-drugs policy agreed by the police and local authority shall be in force.
8 A detailed “Customer Code of Conduct” poster must be displayed.
9 Large groups (e.g. funerals, stag or hen parties, birthdays and anniversaries) must nominate a contact to liase with staff. Where necessary such events must be managed on the basis of individual risk assessment.
The Prevention of Crime and Disorder
10 A policy must be in place not to serve any person who is inebriated.
11 Door supervisors must be provided where appropriate (based on the risk assessment of events).
12 A zero tolerance policy shall be followed in relation to violence on the premises. Anyone involved in violence on the premises must be subject to Torquay Athletic RFC internal disciplinary procedures and may be prosecuted.
Public Safety
13 All parts of the premises and all fittings and apparatus therein (door fastenings and notices and the seating, lighting, heating, electrical, ventilation, sanitary accommodation, washing facilities and other installations) must be maintained at all times in good order and in a safe condition.
14 Staff must be aware of public safety issues.
15 A zero tolerance policy shall be followed in relation to violence on the premises. Anyone involved in violence on the premises must be subject to Torquay Athletic RFC internal disciplinary procedures and may be prosecuted.
16 Plastic glasses and bottles must be provided where appropriate (depending on the type of entertainment provided and the number and behaviour of patrons).
17 All drinking glasses in which drinks are served shall be made of plastic or toughened glass.
18 Only plastic glasses or bottles must be permitted in play areas (pitches), beer gardens or similar.
19 Drinks, whether in drinking glasses or in opened bottles, must not be removed from the premises.
20 All glasses must be correctly stamped in accordance with Weights and Measures Legislation.
21 Door supervisors must be provided where appropriate (based on the risk assessment of events).
22 Exits and fire exits shall be generally acceptable to disabled patrons.
23 Staff must be aware of the needs of patrons and assistance needed in case of emergency evacuation.
24 Up to date fire risk assessments must be maintained.
25 Safety exits must be clearly lit and maintained.
26 Ticketing, headcount, door supervisor or members’ book (based on risk assessments of events) shall control the capacity limit.
27 Adequate access must be provided for emergency vehicles.
28 Regarding the provision of facilities for dancing, a suitable and clearly identifiable area must be made available for this purpose. The minimum area to be set aside shall be four square metres where the event permits a maximum capacity of between 1 and 99 people, six square metres where the event permits a maximum capacity between 100 and 199 people and nine square metres where the event permits a maximum capacity of over 200 people.
An area separate from the main dance area must be provided with:
(a) Adequate seating.
(b) Suitable means of providing cool air by ventilation to the external air
(c) Respite from high levels of noise.
This room shall be acoustically shielded from the main event room by a lobby area.
17. Free drinking water must be available at all times.
18. Adequate first aid arrangements must be provided at all times. An adequate and appropriate supply of first aid equipment and materials must be available for the use of patrons and staff.
19. Gangways, exit routes and steps must be maintained in good order with non-slippery and even surfaces.
20. Fire exits and means of escape must be signed.
21. An evacuation procedure must be in place to the satisfaction of the fire authority and the staff must be trained in this procedure.
22. Exit doors must open outwards.
23. Sufficient numbers of stewards who are suitably trained must be provided on the premises, depending on the activities or entertainment taking place on the site.
24. The Club Steward, or senior member of staff or designated club official must check the premises prior to opening to ensure that there are no risks to patrons and that all safety precautions are in place.
25. A means of addressing patrons during operating hours, which can be heard above entertainment or by interrupting entertainment to make safety announcements, must be provided.
The Prevention of Public Nuisance
1. Noise or vibration will not emanate from the premises such as to cause persons in the neighbourhood to be unreasonably disturbed. Noise from the premises should not be audible within any noise sensitive premises (e.g. dwelling) with windows open for normal ventilation especially after 23:00hrs. The criteria applied, from boundary to nearest residential property are;
(a) Before 23:00hrs- Noise emanating from the premises will not be clearly distinguishable above other noise.
(b) After 23:00hrs- Noise emanating from the premises will not be distinguishable above background levels of noise.
2. The volume of amplified sound used in connection with the entertainment provided shall at all times be under the control of the management and the controlling mechanism shall be operated from a part of the premises not accessible to the public.
3 Prominent, clear and legible notices must be displayed at all exits requesting the public to respect the needs of local residents and to leave the premises and the area quietly.
4. The Licensee must ensure that the staff, who arrive early in the morning and depart late at night when the business has ceased trading, conduct themselves in a manner to avoid causing disturbance to nearby residents.
5. Doors and windows must be kept shut during entertainment to reduce noise breakout.
6. An announcement must be made prior to closing requesting patrons cooperation in leaving the premises and vicinity as quietly and quickly as possible.
7. A specific taxi operator shall be nominated and advertised for staff and customer use. The operators must be made aware that they should arrive and depart as quietly as possible, should not sound vehicle horns as a sign of arrival or leave engines idling unnecessarily.
8. Staff must check prior to entertainment and periodically during the entertainment that windows and doors are shut.
9. The Club Steward, senior member of staff or designated club official must assess the impact of any noisy activities on neighbouring residential premises at the start of the activity/entertainment and periodically throughout the activity/entertainment to ensure that levels of noise have not increased.
10. Regular maintenance must be carried out on all plant and machinery to ensure that noise disturbance from such sources is kept to a minimum.
11. The handling of beer kegs, bottles and other similar items will not take place in the late evening, at night or in the early morning, when the noise generated could cause a nuisance particularly outside buildings.
12. The delivery of goods must be restricted to the following times: 08:00-17:30hrs.
13. Bottle skips and bins containing cans or bottles must not be emptied outside after closing but must be dealt with the next day during normal office hours.
14. The movement of bins and rubbish outside the premises must be kept to a minimum after 23:00hrs. This will help to reduce the levels of noise produced by the premises.
15. Staff shall monitor the use of the car park to ensure that patrons do not congregate in this area and cause annoyance.
16. The premises shall remain open for at least half an hour after the sale of alcohol has ceased, during which time patrons shall be gradually dispersed.
17. Particularly bright lights on or outside the premises must be positioned and screened in such a way so as not to cause a disturbance to nearby properties.
18. The use of lighting in gardens and external areas must cease at 00:00, except for health and safety or security reasons.
19. All rubbish produced by the premises must be stored securely in a designated area or in a bin with a tight fitting lid. This shall prevent litter being blown around.
20. Facilities for depositing litter and the collection of litter generated by patrons must be provided and maintained, where outside areas are provided for use by patrons. Adequate refuse bins must also be provided for the use of patrons.
The Protection of Children from Harm
1 Children in the bar area must be supervised by at least 2 rostered adult club members on Junior Section match and training days.
2 A Child Protection Officer or a suitable authorised nominee must be present at all times when children are in the bar area on Junior Section match and training days.
3 The sale of alcohol to persons under the age of 18 must be prevented, with appropriate identification being sought where necessary in line with the Torbay Council’s Statement of Licensing Policy.
4 Staff must be trained in the law relating to the service of alcohol to under 18’s and as to the presence of under 18’s in the bar.
5 The Presidents Lounge is a non-smoking area and the whole clubhouse shall be designated a no smoking zone on Junior Match days (normally but not limited to Sunday mornings).
6 Children under the age of 12 shall not be present after 23:00hrs (only applicable when alcohol is not being served).
7 No persons under the age of 16 shall be employed as an attendant on the premises.
8 Cigarette machines must be under the supervision of the management.
9 Cigarettes and other tobacco products must not be sold to anyone under 16 and a notice to this effect must be displayed.
