ANNEX 1
MANDATORY CONDITION: WHERE LICENCE AUTHORISES SUPPLY OF ALCOHOL
1) No supply of alcohol may be made under the premises licence:-
() at a time where there is no designated premises supervisor in respect of the premises licence, or
() at a time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended.
2) Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3) (1) The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
(2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises:-
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to:-
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective;
(d) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner;
(e) dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).
4) The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.
5) (1) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.
(2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.
(3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either:-
(a) a holographic mark, or
(b) an ultraviolet feature.
6) The responsible person must ensure that:-
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures:-
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml;
(b) these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and
(c) where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available.
Minimum Drinks Pricing
1) A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.
2) For the purposes of the condition set out in paragraph 1
(a) “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979
(b) “permitted price” is the price found by applying the formula P = D + (DxV)
Where:-
(i) P is the permitted price
(ii) D is the amount of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and
(iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;
(c) “relevant person” means, in relation to premises in respect of which there is in force a premises licence:-
(i) The holder of the premises licence
(ii) The designated premises supervisor (if any) in respect of such a licence, or
(iii) The personal licence holder who makes or authorises a supply of alcohol under such a licence;
(d) “relevant person” means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and
(e) “value added tax” means value added tax charged in accordance with the Value Added Tax Act 1994.
3) Where the permitted price given by Paragraph (b) of paragraph 2 would (apart from the paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny.
4) (1) Sub-paragraph (2) applies where the permitted price given by Paragraph (b) of paragraph 2 on a day (“the first day”) would be different from the permitted price on the next day (“the second day”) as a result of a change to the rate of duty or value added tax.
(2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.
MANDATORY CONDITION: DOOR SUPERVISION
1) Where one or more individuals are carrying out security activities, each individual must be licensed by the Security Industry Authority.
2) But nothing in the aforementioned conditions requires such a condition to be imposed in respect of a) and b) and (b)(i) and (b)(ii)
a) in respect of premises within paragraph 8(3)(a) of Schedule 2 to the Private Security Industry Act 2001 (c. 12) (premises with premises licences authorising plays or films), are exempt.
b) In respect of premises in relation to:
i) any occasion mentioned in paragraph 8(3)(b) or (c) of that Schedule (premises being used exclusively by club with club premises certificate, under a temporary event notice authorising plays or films or under a gaming licence), or
ii)any occasion within paragraph 8(3)(d) of that Schedule (occasions prescribed by regulations under that Act).
3) For the purposes of the aforementioned conditions:
a) “security activity” means an activity to which paragraph 2(1)(a) of that Schedule applies, and
b) paragraph 8(5) of that Schedule (interpretation of references to an occasion) applies as it applies in relation to paragraph 8 of that Schedule.
ANNEXE 2
CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
General
1. All equipment, appliances and buildings must be maintained in good or working order by the licensee.
2. The licensee must be fully conversant with the publication "The Event Safety Guide" produced by Health and Safety Executive ISBN 071624536.
3. A copy of the Premises Licence must be displayed in a conspicuous position on the premises and available for inspection by Police, Fire Authority and authorised officers of the Council.
4. The licensee shall work with all emergency/responsible authorities to ensure the event is safe and has minimal environmental impact as possible.
5. The licensee will closely monitor recommended capacity numbers in the grounds and clubhouse.
The Prevention of Crime and Disorder
1. The Police and relevant authorities will be notified by the licensee three months prior to any event to discuss and confirm event details and supervision requirements including the possibility of SIA security numbers required for the event.
2. All SIA and stewards must be readily identified by wearing distinctive clothing or high visibility jackets.
3. There shall be a constant security presence at the entrance and exit points and regular patrolling will take place throughout the site during all events.
4. No glass bottles or containers will be permitted on site and all alcohol and soft drinks including water will be served in plastic vessels for open air events.
5. The existing CCTV system shall operate at all times when the premises are trading and the equipment shall be maintained to the satisfaction of the Chief of Police. Recorded images will be retained for 30 days and made available to the Police on request. The Police and Licensing Authority shall be informed as soon as possible if the CCTV equipment is inoperative and immediate steps will be taken to put the equipment back into action.
6. There shall be zero tolerance to disorderly conduct and drunkenness on the premises. An incident log book shall be maintained by the licensee and kept on the premises and will be available for inspection by responsible authorities.
7. The licensee will ensure that adequate lighting is provided whilst the public is on site.
8. Drinking water shall be available at all times.
Public Safety
1. No event shall take place during the cricket season from 30th April - 1st September.
2. The licensee must have the following in place for open air events:
a) An event management plan for the event.
b) Fire risk assessment and general risk assessment.
c) A management structure (i.e. Safety Officer / First Aiders / SIA / Stewards).
d) Emergency plan and evacuation plan.
3. The Safety Officer must be available throughout the duration of the event.
4. The licensee shall ensure that there is no public access to areas where machinery or fireworks or pyrotechnical equipment is stored.
5. The licensee shall keeep a log book of all accidents and incidents including disruptive behaviour and any complaints made by the public.
6. The licensee will keep all entrances and exits unobstructed.
7. The licensee shall store cleaning products away from public areas.
8. Wet surface signs shall be used by staff in the event of spillages and when cleaning takes place.
9. The licensee shall ensure there is access for emergency vehicles on to the ground.
10. The licensee shall have fire safety precautions in place (designated incident controllers and floor marshalls) and fire extinguishers installed.
11. The licensee will ensure that there is an annual fire system check and fire drills.
12. When an event is planned and the major inducement is the sale of alcohol (from a bar and for consumption on the premises) or the major inducement is the performance of live amplified music or a fireworks display, the following conditions shall apply if it is anticipated that 500 or more people shall be in attendance at any given moment:
a) A detailed risk assessment shall be carried out by the licensee and submitted to the relevant Responsible Authorities including the Police at least three months prior to any planned event.
b) The management shall ensure that there are suitable numbers of staff on duty at large events to control persons entering and leaving the event and to disperse queues as quickly as possible.
c) Readily identifiable marshalls shall be employed by the licensee in Queens Road and Sands Road to manage queues and assist with the safe entry and exit of those attending outdoor events - particularly the annual Beer Festival and annual Fireworks Display.
d) The management shall ensure that premises car parks are monitored and there will be sufficient lighting provided to prevent accidents from occurring.
e) Clear and conspicuous signage shall be erected by the licensee at either end of Queens Road to direct pedestrians to use the most appropriate route when entering and leaving events on foot.
f) Stewards shall be on hand to ensure that the premises car park entrances are closed as the event closes.
13. The arrangements for public safety shall be paramount at all events, in particular the Beer Festival and fireworks display, in accordance with the statement of general policy risk assessment and arrangements provided by the licensee.
14. The licensee will use a ticket numbering system or clicker system on the main entrance to monitor the number of people attending the event and to manage capacity in the Clubhouse.
15. The licensee will ensure that contractors and sub-contractors have all relevant insurances, safe practice of work risk assessments and method statements in place.
The Prevention of Public Nuisance
1. All amplification speakers shall be operated towards the clubhouse or as advised by Environmental Health.
2. The event organisers' details shall be given prior to the event taking place.
3. Prior to commencement of the event, sound checks shall be undertaken by Environmental Health as appropriate.
4. The volume of amplified sound must be under the control of a designated member of staff and will be monitored from the areas backing onto residential developments.
5. Where an event is planned and the major inducement is the sale of alcohol (from a bar and for consumption on the premises) or the major inducement is the performance of live amplified music or the annual Beer Festival or a fireworks display, the following conditions shall apply if it is anticipated that 500 or more people shall be in attendance at any given moment:
a) Noise from the premises shall not be audible within any dwelling with windows open for normal ventilation, especially after 11pm; the exception to this will be the fireworks display but this shall be assessed with advice from Environmental Health. The assessment for noise shall be from the boundary to the nearest residential properties on all sides of the licensed premises. Save for the fireworks display, the criteria that shall be applied is as follows:
i) Before 11pm, noise emanating from the premises shall not be clearly distinguished from other noise.
ii) After 11pm, noise emanating from the premises shall not be distinguishable above background levels of noise.
iii) Local Authorities shall reserve the right to make further assessments from within the residential property in cases of internal noise and where premises are attached to others.
iv) The fireworks display shall not be permitted to continue after 9pm.
b) The Designated Premises Supervisor or a senior member of staff shall assess the impact of any noisy activities on neighbouring residential premises at the start of the activity or entertainment and periodically throughout the activity or entertainment to ensure the level of noise has not increased.
c) In respect of the Beer Festival and fireworks display or similar events, the licensee shall ensure that clear and unobstructed signs are displayed at all points of exit encouraging patrons to leave the premises quietly and with respect for local residents.
d) The licensee shall ensure that announcements are broadcast by loudspeaker system at least 30 minutes prior to closing requesting that patrons co-operate in leaving the premises and vicinity as quickly and quietly as possible.
6. The licensee shall ensure that there is no public access to areas where machinery is stored and that fireworks and pyrotechnical equipment shall be stored until use under present recommended guidelines.
7. The occupancy of the building shall be monitored at all times by staff.
8. All staff shall be trained to deal with difficult customers.
9. The licensee will ensure that the site is locked at the end of each day and there shall be no public access after closing.
10. The licensee shall ensure that the tills are left open and empty and all cash is locked in the safe at the end of every day.
11. Drunk and disorderly behaviour shall not be permitted.
12. SIA door stewards shall be employed at the site on occassions of large outdoor events which involve the sale of alcohol and live entertainment.
13. The licensee shall ensure that all drinks are served in cans, polycarbonate or plastic glasses at all outdoor events.
The Protection of Children From Harm
1. Staff shall be trained to prevent the sale of alcohol to those under 18 years old. A proof of age for any customer purchasing alcohol that appear to be under 25 years old.
2. Clearly marked signs shall be prominently on the premises displayed for the sale of soft drinks and water.
3. The licensee will serve all drinks in plastic glasses, bottles or cans for consumption outside and at all outdoor events.
4. When an event is planned and the major inducement is the sale of alcohol (from a bar and for consumption on the premises) or the major inducement is the performance of live amplified music or a fireworks display, the following conditions shall apply if it is anticipated that 500 or more people shall be in attendance at any given moment:
a) All staff, including casual staff employed for outdoor events, shall be suitably trained to prevent the sale of alcohol to those under 18 years old.
b) Staff training shall be recorded and regularly reviewed by the management to ensure that all members of staff have received sufficient training and are aware of their responsibilities with regards to the sale of alcohol. Training records will be kept on the premises for at least 12 months and shall be readily available for inspection by Police Officers, Police Licensing Officers or Council Licensing Officers.
c) All children under the age of 16 years old must be accompanied by a parent or responsible adult at all large outdoor events where alcohol is on sale. If necessary, the licensee shall issue coloured wristbands to identify people under 18 years old.
d) The licensee shall ensure that no person under the age of 18 years old is permitted on site after 6pm during the Beer Festival.
e) The licensee shall ensure that no person under the age of 18 years old is permitted on site after 9pm in the event of the fireworks display.
5. The licensee shall have provision for lost children throughout any outdoor event and those responsible for this provision must be disclosure checked.
ANNEXE 3
CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
The Prevention of Public Nuisance
1. Noise or vibration shall not emanate from the premises such as to cause persons in the neighbourhood to be unreasonably disturbed. In general terms, noise from the premises should be at a reasonable volume so as not to cause a nuisance.
2. The application shall be limited to allow for such events to take place up to six times a year.
3. Doors and windows shall be kept shut during entertainment to reduce noise breakout. A management scheme shall be in place to ensure this situation remains.
4. A senior member of staff (manager) shall assess the impact of any noisy activities on neighbouring residential premises at the start of the activity/entertainment and periodically throughout the activity/entertainment to ensure levels of noise have not increased.
5. Prior to outside entertainment Environmental Health shall be consulted with regard to the positioning of equipment such as speakers. It may be necessary for Environmental Health and carry out sound testing prior to the event.
