Additional Conditions

ANNEXE 1
MANDATORY CONDITION: WHERE LICENCE AUTHORISES SUPPLY OF ALCOHOL

(1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

(2)   In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -

                                 (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to -

                            (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

                      (ii)   drink as much alcohol as possible (whether within a time limit or otherwise);

                          (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);

                              (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;

                    (d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on -

                               (i)        the outcome of a race, competition or other event or process, or

                                (ii)               the likelihood of anything occurring or not occurring;

                (e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti social behaviour or to refer to the effects of drunkenness in any favourable manner.

(3)              The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).

(4)              The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.

(5)                             (1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.

                                   (2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

(6).               The responsible person shall ensure that -

                          (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures     -

                              (i) beer or cider: ½ pint;

                              (ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and

                              (ii) still wine in a glass: 125 ml; and

            (b) customers are made aware of the availability of these measures.
MANDATORY CONDITION: EXHIBITION OF FILMS

1)       Where the film classification body is specified in the licence, admission of children must be restricted in accordance with any recommendation made by that body.

2)       Where -

()        the film classification body is not specified in the licence, or

()        the relevant licensing authority has notified the holder of the licence that this condition applies to the film in question,

admission of children must be restricted in accordance with any recommendation made by that licensing authority.

In the case of the aforementioned conditions
              “children” means persons aged under 18; and
              “film classification body” means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (authority to determine suitability of video works for classification).
ANNEXE 2

CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Restrictions transferred from the Club Premises Certificate

Alcohol shall not be sold or supplied except during permitted hours.

The above restriction does not prohibit:

(a)               during the first twenty minutes after the above hours, the taking of the alcohol from the premises, unless the alcohol is supplied or taken in an open vessel;

(b)               the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;

(c)               the sale of alcohol to a trader or club for the purposes of the trade or club;

(d)               the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;

Alcohol shall not be sold in an open container or be consumed on the licensed premises.

Credit Sales

Alcohol shall not be sold or supplied unless it is paid for before or at the time when it is sold or supplied, except alcohol sold or supplied to a canteen or mess.
General

1.              Entry to the club premises shall be restricted to members and their guests.

2.              Amplified music shall not be played more often then once per month.

3.              The club premises must be used to encourage the sport of sailing among local residents and their families.

The Prevention of Crime and Disorder

1.              Only members and their guests shall be admitted to the club.

2.              Bar staff must be trained not to serve under 18s and shall ask for proof of age if necessary.

3.              The premises shall be open for twenty minutes after sale of alcohol stops, so members can leave gradually.

4.              Notices shall be in place requesting members to leave quietly.

5.              Empty glasses shall be collected regularly.

Public Safety

1.              Adequate access shall be provided for emergency vehicles.

2.              Annual health and safety risk assessments shall be carried out on the premises and all equipment shall be maintained to the required standards.

3.              A ventilation system must be installed.

4.              Several members of the club must have first aid qualifications.

5.              No entertainment of an unsuitable or inappropriate type shall be offered.

6.              There must be a clearly defined dance floor.

7.              No curtains must hang over the exits.

8.              The premises must be on the ground floor only.

9.              A fire risk assessment must be in place and there must be three fire exits including one with disabled egress.

10.              The club must have restricted smoking areas and shall abide by any future changes to the law regarding smoking.

11.              There must be adequate lighting.

The Prevention of Public Nuisance

1.              Windows and doors must be kept closed when amplied music is played.

2.              Windows and doors must be closed by 11pm.

3.              Noise levels must be controlled by the Rear Commodore and bar staff, and shall not be at a level so as to damage anyone's hearing.

4.              Notices shall be in place requesting members to leave quietly.

5.              Emptying of refuse and deliveries of kegs and bottles shall be done in daylight hours.

6.              The premises shall be open for 20 minutes after sale of alcohol stops so that members can leave gradually.

7.              Adequate dustbins must be in place to prevent litter.

The Protection of Children From Harm

1.              Bar staff must be trained not to serve under 18s with alcohol, and must only admit children to watch films with BBFC classifications appropriate to their ages.

2.              Signage shall be in place making these policies clear.

3.              Staff shall ask for proof of age if necessary.

4.              Entry to the club must be restricted to members and their families and guests.

5.              Junior members must not be allowed in the bar unsupervised.

6.              The club must have a child protection officer for its sailing activities and must be aware of child protection and safeguarding procedures.

7.              A number of the club's officers must be CRB checked.
