  MANDATORY CONDITION:  WHERE LICENCE AUTHORISES SUPPLY OF ALCOHOL

   

  1)       No supply of alcohol may be made under the premises licence:-
   

  ()        at a time where there is no designated premises supervisor in respect of the premises licence , or
   

  ()        at a time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended.

   

  2)              Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

  ANNEXE 2

   

  CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

• Additional Condtions Transferred from the Licence

   

  1.              CCTV to be installed at the premises, to be maintained and used throughout licensing hours.  CCTV to have full recording facilities with a monitor for use by staff.  All recordings to e kept for a minimum of 31 days, during which time the police shall have access at any reasonable time.

   

  2.              At any time when both floors are in use, both bar serveries are to be manned.

   

   

• General

   

  None

   

  The Prevention of Crime and Disorder

   

  1.              The 30 minute extension of opening hours after the end of the sale of alcohol shall enable final drinks to be consumed less quickly.

   

  2.              Customers in both the wine bar and the restaurant areas shall normally be seated at all times.

   

  3.              CCTV coverage shall be in place throughout the premises.

   

  4.              No drinks shall be permitted to be consumed from bottles.

   

  5.              There shall be no requirement for door staff.

   

  6.              Provision of alcohol shall normally be by way of waiter/waitress service.

   

  Public Safety

   

  1.              The majority of customers shall be seated whilst on the premises, whether on the first floor or on the ground floor.

   

  The Prevention of Public Nuisance

   

  1.              Provision of music and dancing shall not occur on a daily basis but shall be available in response to customers' demand.

   

  2.              The double entrance doors and solid construction of the property shall ensure that there is a reduced risk or disturbance to passers by and residents in the area.

   

  The Protection of Children From Harm

   

  1.              Bar staff shall be trained to be aware of and alert to issues of underage drinking.

  ANNEXE 3

   

  CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY

   

• Public Safety

   

  1.              A CCTV system of an evidential standard shall be installed to the satisfaction of the police, and the system to be in operation at all times the premises are open to the public.  All recordings from that system shall be kept for a period of 31 days and the police to have access to recordings at any reasonable time.

   

  2.              There shall be no entry or re-entry to the premises after 12 midnight.

   

  The Prevention of Public Nuisance

   

  1.              Live and recorded music and facilities for dancing shall be permitted 4 times a month between 18.00hr - 01.00hr and between 18.00hr - 03.00hr on New Years Eve.

   

  2.              Noise or vibration shall not emanate from the premises such as to cause persons in the neighbourhood to be unreasonably disturbed.  In general terms, noise from the premises should not be auidble within any noise sensitive premises (e.g. dwelling) with windows open for normal ventilation especially after 23.00hr.  This shall be assessed from the boundary to the nearest residential properties, on all aides of the licensed premises.  The criteria that shall be applied are;

                (i)              Before 23.00hr - Noise emanting from the premises shall not be clearly distinguishable above other noise.

                (ii)              After 23.00hr - Noise emanting from the premiss shall not be distinguishable above background levels of noise.

                (iii)              The local authority shall reserve the right in cases of tonal noise and where premises are attached to others (i.e. semi's and terraced properties), to make further               assessments from within the residential property.
