General
1. The premises shall promote food and create a family friendly environment.
The Prevention of Crime and Disorder
1. All drinks must be served in toughened or strengthened glass and no alcohol shall be served in glass bottles from which it is intended or likely that a person shall drink after 23.00.
2. The management shall operate the Challenge 21 system.
3. The premises shall operate a strict no drugs policy. A secure facility to store controlled drugs shall be available.
4. A CCTV system of an evidential standard shall be installed to the satisfaction of the police and kept in operation at all times that the premises are open to the public, and all recordings from that system must be kept for a period of 14 days and the police shall have access to any such recordings at any reasonable time.
Public Safety
1. A log book shall be kept on the premises in which particulars of inspections shall be entered.
2. All parts of the premises, including all fittings and apparatus, door fastenings, seating, lighting, electrical ventilation, sanitary accommodation, washing facilities and the like shall be maintained in good order and safe condition at all times.
3. Where glazing forms part of the structure of the premises, it shall be constructed of safety materials which are inherently robust.
4. Free drinking water shall be made available at all times that the premises are open to customers.
5. The toilets shall have suitable and sufficient lighting with provision.
6. Emergency lighting shall be maintained in working order and capable of use. It shall not be controllable from any place accessible to the public. It shall be tested by a qualified electrician who will examine the system at periods of not less than 12 months and a record of that examination shall be made available to the officer of any responsible authority. In the event of the failure of the general lighting, members of the public shall be required to leave the premises.
7. No portable hearing appliances of any description shall be used on the premises whilst the public are present.
8. Any heating appliances, including stoves or fires, forming an integral part of the structure shall be efficiently and effectively fixed and guarded. They should be situated at a safe distance from any combustible material or substance.
9. The fire safety measures with which the premises are provided must be maintained in good working order and they adequacy shall be determined on a regular basis by the carrying out of a fire risk assessment as required by and in accordance with the Regulatory Reform (Fire Safety) Order 2005. The licensee understands that the safety of occupants is influenced by the number present, their disposition, and the activities taking place within the premises, and shall maintain a safe occupancy level.
The Prevention of Public Nuisance
1. The premises shall provide substantial refreshment and non-alcoholic beverages.
2. Noise or vibration shall not emanate from the premises so as to cause persons in the neighbourhood to be unreasonably disturbed. The noise shall not be audible within any noise sensitive premises with windows open for normal ventilation especially after 11pm. The criteria that shall be applied, from boundary to nearest residential property, are:-
(1) Before 11pm - noise emanating from the premises shall not e clearly distinguishable above other noise;
(2) After 11pm - noise emanating from the premises shall not be distinguishable above background levels of noise;
(3) The Local Authority shall reserve the right in cases of tonal noise, and where the premises are attached to others, to make further assessments within the residential property.
3. The placing of refuse, such as bottles, into receptacles outside the premises must take place at times that will prevent disturbance to nearby properties.
4. The handling of beer cases, bottles and other similar items shall not take place in the late evening, at night, or during the early morning when the noise generated might cause a nuisance to nearby properties.
5. The volume of amplified sound used within the premises shall at all times be under the control of the management and shall not be accessible to members of the public.
6. Staff shall encourage customers leaving the premises after 23.00 to have consideration for residents in the neighbourhood.
7. No cooking, noxious or persistent smells shall be allowed to emanate from the property.
The Protection of Children From Harm
1. Children shall not be permitted on the premises unless accompanied at all times by a responsible adult.
