  MANDATORY CONDITION:  WHERE LICENCE AUTHORISES SUPPLY OF ALCOHOL

   

  1)       No supply of alcohol may be made under the premises licence:-
   

  ()        at a time where there is no designated premises supervisor in respect of the premises licence , or
   

  ()        at a time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended.

   

  2)              Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

  ANNEXE 2

   

  CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  General

   

  1.              The premises must fully comply with the conditions of the Torbay Street Cafe Permit granted in               June 2007, in particular adequate supervision of the front area.

   

  2.              There must be no external music.

   

  3.              Tables and chairs must be kept within the agreed boundary.

   

   

  The Prevention of Crime and Disorder

   

  1                      CCTV must be provided and maintained in good working order.

   

  2                      Close working relationship with Police shall be maintained with regard to drugs and crime.

   

  3                      Zero Tolerance policy on drugs must be maintained.

   

  4                      Irresponsible drinks promotions are prohibited.

   

  5                      Staff must be adequately trained to prevent the sale of alcohol to persons under the age of 18 years, requesting appropriate written proof of age.

   

  6                      Membership in the Paignton Nitenet Radio Link must be maintained.

   

  7                      Patrons shall be prohibited from leaving the premises with any glass or bottles belonging to the premises.

   

   

  Public Safety

   

  8                      The premises shall remain open after the sale of alcohol for half an hour to ensure patrons leave in an orderly manner.

   

  9                      All escape routes and exits will be kept free from obstruction, in good order and with non-slippery and even surfaces.

   

  10                  Health and safety assessments must be carried out and reviewed regularly.

   

   

  The Prevention of Public Nuisance

   

  11                  Prominent, clear and legible notices must be displayed at exits requesting customers to leave quietly.

   

  12                  Bottles must be disposed of during daylight hours.

   

  13                  All refuse must be secured in bins.

   

  4.              Windows and inner doors (save for entrance and exit purposes) shall remain shut after 11pm when recorded music is played.

   

  5.              Windows and inner doors shall be kept shut after 11pm when amplified entertainment is being               played.

   

  6.              Management (as at present) shall continue to monitor and check sound levels outside the               premises, particularly after 11pm, to ensure no nuisance is caused.

   

   

  The Protection of Children from Harm

   

  14                  Persons under the age of 18 years will be prohibited from entering or remaining on the premises after 21:00hr.

   

  15                  All Amusement with prizes machines must be sited to ensure they are under direct supervision of the staff at all times.

   

  16                  A full range of soft drinks, including free water, shall be available.

  ANNEXE 3

   

  CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY

   

  The Prevention of Public Nuisance

   

   

  1                      Noise or vibration will not emanate from the premises such as to cause persons in the neighbourhood to be unreasonably disturbed. Noise should not be audible within any noise sensitive premises with windows open for normal ventilation especially after 23:00hr. The critera applied, from the boundary to the nearset residential properties are;

   

                (a)              Before 23:00hr- Noise emanating from the premises will not be clearly distinguishable above other noise.

   

                (b)              After 23:00hr- Noise emanating from the premises will not be distinguishable above background levels of noise.

   

                (c)              The local authority will reserve the right in cases of tonal noise and where premises are attached to others (i.e. semi’s and terraced               properties), to make further               assessments from within the residential property.

   

  2.              The volume of amplified sound used in connection with the entertainment provided shall at all times be under the control of the Licensee/ Management and the controlling mechanism shall be operated from a part of the premises not accessible to the public.

   

  3.              The movement of bins and rubbish outside the premises will be kept to a minimum after 23:00hr.

   

   

  The Protection of Children from Harm

   

  2                      No alcohol will be sold to any person under the age of 18. Age identification will be sought from any person appearing to be under the age of 18 years.

   

  3                      Staff will receive training on matters related to the sale of alcohol.
