To consider an application for a Premises Licence in respect of Bargain Booze, 105 Foxhole Road, Paignton. Additional documents:
Minutes: Members considered a report for an application for a Premises Licence in respect of Bargain Booze, 105 Foxhole Road, Paignton TQ3 3SU.
Written Representations received from:
Members noted the additional documentation circulated with the Agenda which outlined Bargain Booze the Company, excerpts from the internal and external training and other policies.
Oral Representation received from:
Members noted there have been no Representations received from any Responsible Authority.
Copies of the Minutes of a Licensing Sub-Committee dated 28 July 2011 in respect of an application for a Premises Licence in respect of PB Stores, 105 Foxhole Road, Paignton TQ3 3SU and a Case Law document were made available to Members as these were referred to in the Oral Representation.
Decision:
That the application for a Premises Licence in respect of Bargain Booze, 105 Foxhole Road, Paignton TQ3 3SU be granted as applied for, subject to the following two additional Conditions;
That the notice as circulated at Committee hearing by the Applicant’s Legal Representative be prominently displayed within the store and an A3 size of the notice be displayed in a prominent position in the window of the premises; and
That in ‘all due diligence’ a refusal log must be kept to record when sales of alcohol are challenged or refused and that this log shall be made available to the Police and the Local Authority, upon request.
Reason for Decision:
Having carefully considered all the Oral and Written Representations, Members gave due consideration of the concerns raised by the Interested Parties in particular respect to the Protection of Children from Harm and Anti Social Behaviour, however they noted the absence of any Representation from Safeguarding Children, Trading Standards and the Police in support of these concerns or of the application itself.
Having heard from the applicants Legal Representative on issues raised by the Interested Parties, Members were reassured that the Conditions imposed on the Premises Licence would alleviate these concerns and that compliance by the Premises Licence Holders and their staff of the manual as circulated at Committee would promote the Licensing Objectives.
